Plaintiff is Classic Solutions, Inc., a Pennsylvania corporation with its principal place of business located at 418 Market Street Rear, Lemoyne, Cumberland County, Pennsylvania 17043 ("Classic"). 2. Defendant is Restore America, Inc., trading or doing business as Exact Restorations, a Pennsylvania corporation with its principal place of business located at 333 Lexington Street, York, York County, Pennsylvania 17403 ("Exact Restorations"). 3. Classic and Exact Restorations entered into an agreement whereby Classic was to perform certain garment and textile restoration services for Exact Restorations. 4. Classic has performed said services for Exact Restoration at Classic's Carlisle, Pennsylvania plant in an amount totaling $26,350.04. True and correct copies of Classic's Statement dated March 2, 2005 and six (6) supporting invoices totaling $26,350.04 are attached hereto as Exhibit A and incorporated herein by reference. 5. Exact Restoration has already been paid the aforesaid $26,350.04 by insurance companies providing coverage for the work performed by Classic. 6. On or about March 9, 2005, Exact Restorations paid Classic the sum of $12,791.48, leaving an outstanding sum of $13,558.56 due and owing Classic. 7. Despite repeated demands by Classic for payment of the aforesaid outstanding amount, Exact Restorations has failed and continues to fail to pay Classic the outstanding amount due and owing Classic. 8. In its fax dated January 5, 2005, Exact Restorations admitted that it owed Classic at least $20,127.70. A true and correct copy of said fax is attached hereto as Exhibit B and incorporated herein by reference. 9. As a direct and proximate result of Exact Restorations' failure to pay Classic the amount it was owed, Classic has been forced to borrow money against its line of credit at a yearly interest rate of 5.5%, thereby incurring interest charges totaling $603.85 to date, making the total amount due and owing Classic $14,162.41. WHEREFORE, Plaintiff Classic respectfully requests this Honorable Court enter judgment in its favor and against Exact Restorations in the amount of $14,162.41, plus interest, attorney's fees, costs and such additional relief as this Court deems just and proper.
