Hereinafter referred to as Contractor, �`-
AND
L. DAVID WETZEL AND MARILYN M. WETZEL, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and construct a
SINGLE FAMILY DWELLING on that certain lot of ground situate in
7710 Wertzville Road Carlisle, PA 17013
NOW THEREFORE, THIS AGREEMENT WITNESSTH: That the said Contractor,
for and in consideration of the sum of ($1.00) Dollar to L. DAVID WETZEL AND
MARILYN M. WETZEL in hand paid by Owner,.the receipt whereof is hereby
acknowledged, and further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them,
covenant and agree that no mechanics liens or claims shall be filed or maintained by them
or any of them against the said buildings and the lot of ground appurtenant thereto for or
on account of any work done or materials furnished by them or any of them under said
contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN lot of ground, Situate in Middlesex Township, Cumberland County, Pennsylvania,
bounded and described in accordance with a Final Subdivision Plan for Lester P Wetzel by Larry V. Neidlinger,
Registered Professional Land Surveyor, dated March 10, 1989, and recorded in Cumberland County Plan
Book 58, Page 78, as follows:
BEGINNING at a point in the center of State Route 944 at corner of lands now or formerly of Harry Shuman;
thence by the center line of the said State Route 944, South 71 degrees 07 minutes 29 seconds West 200.00
feet to a nail set; thence by other lands now or formerly of Lester P. and Jane C. Wetzel and through an iron
pin set 25 feet from said center line, North 18 degrees 52 minutes 31 seconds West 399.67 feet to an iron pin;
thence by the same, North 71 degrees 07 minutes 29 seconds East 313.66 feet to an iron pin set on a fence
line; thence along said fence line and lands now or formerly of Harry Shuman, South 03 degrees 00 minutes
East 415.52 feet through a post set at 25.99 feet from and to a point, the Place of BEGINNING.
BEING Lot 2 on said Plan of Lots.

BEING the same premises which L. David Wetzel, married man, by Deed dated 01/14/2005 and recorded
01/19/2005 in the Office of the Recorder of Deeds iri and for the County of Cumberland in Record Book 267,
Page 988, granted and conveyed unto L. David Wetzel and Marilyn M. Wetzel, husband and wife, as tenants
by the entirety.
