LAST WILL AND TESTAMENT
OF
MARY H. BAUER
I, MARY H. BAUER, of the Borough of New Cumberland, County of
Cumberland and Commonwealth of Pennsylvania, declare this to be my
last will and revoke any will previously made by me.
ITEM I : I devise and bequeath my household goods and personal
effects and other tangible personalty of like nature, not including
cash or securities as follows :
A. This will confirm that I have previously given
to my daughter, CYNTHIA B. PETRY, my complete dining room suite .
Certain pieces of this furniture set are in the possession of my
daughter, M. MINETTE BAUER, who has agreed to turn these over to
CYNTHIA at a mutually agreed upon time .
B. My cut glass (three-legged round dish) to my son, ERIC
WILLIAM BAUER.
C. My cut glass vase to my daughter, FRANCES BAUER
McBRIDE. (This piece was given to me by this daughter and I would
like to have it returned to her upon my death) .
D. I bequeath my jewelry to my daughter, CYNTHIA B.
PETRY, to be retairled by h�r or to be distributed by her to my
children and grandchildren in her sole and absolute discretion.
E. I give and bequeath the remainder of my personal and
tangible property, as above defined, to my c�hildren, irr�;••equal

Nothing is to be sold at public sale unless agreed upon by my
children. There are personal items belonging to them remaining in
my house at 704 Elkwood Drive, New Cumberland, Pennsylvania, which
they shall have free will to remove as soon as convenient . Any
undesired items may be sold and the proceeds added to my residuary
estate.
ITEM II : I give and bequeath my Hershey Creamery stock to my
daughter, CYNTHIA B. PETRY.
ITEM III : I have previously purchased a property at 423
Haldeman Boulevard, New Cumberland, Pennsylvania and placed the
deed in joint names with my son, ERIC WILLIAM BAUER. I hereby
declare that I intend this conveyance to have created a joint tenancy
with right of survivorship and not a tenancy in common, and that
should ERIC WILLIAM BAUER survive me and become the owner of that
property as the surviving j oint tenant that this property shall not
be considered part of my probate estate for purposes of calculating
ERIC WILLIAM BAUER' s share of my estate as a residuary beneficiary.
ITEM IV: I give and bequeath One Thousand ($1, 000 . 00) Dollars
to the GRACE UNITED METHODIST CHURCH of State and Susquehanna
Streets, Harrisburg, Pennsylvania, in memory of my parents, DR. and
MRS . SAMUEL F. HASSLER, and my late husband, ERIC M. BAUER.
ITEM V: I give to my daughter, CYNTHIA B. PETRY, the option
to purchase my apartment building at 425 Haldeman Blvd. , New
Cumberland, Pennsylvania for a purchase price equal to the county
assessed value at the time of my death. Cynthia may exercise this
right by giving notice within 60 days of the date of my death and
by closing and settling within nine months of the date of my death.
In the event Cynthia fails to exercise this right, my son ERIC

WILLIAM BAUER, shall have the right to purchase the property under
similar terms . Eric shall give notice of his intention to close
within 60 days after Cynthia has given notice of her intention not
to purchase or failed to timely give notice of her intention to
purchase. Settlement shall occur within nine months of the date of
my death. All rights hereunder to purchase shall automatically
terminate if not exercised and settled within nine months after my
death. Should my daughter, CYNTHIA B. PETRY, purchase this
property, my son, ERIC WILLIAM BAUER, shall have a license to use
the garage on the property. All maintenance expenses shall be paid
by Eric. The license shall terminate when Eric no longer owns 423
Haldeman Boulevard, or when Cynthia no longer owns 425 Haldeman
Boulevard.
ITEM VI : All the rest, residue and remainder of my estate I
give, devise and bequeath to my issue, per stirpes .
ITEM VII : I appoint my Executrix and her successors guardian
of any property which passes either under this will or otherwise,
to a minor and with respect to which I am authorized to appoint a
guardian and have not otherwise specifically done so, provided that
this appointment of a guardian shall not supersede the right of any
fiduciary in its discretion to distribute a share where possible
to the minor or to another for the minor ' s benefit . Such guardian
shall have the power to use principal as well as income from time
to time for the minor' s support and education (including college
education, both graduate and undergraduate) without regard to his
or her parent ' s ability to provide for such support and education,
or to make payment for these purposes, without further

responsibility, to the minor or to the minor ' s parent or to any
person taking care of the minor.
ITEM VIII : The Executrix shall be entitled to compensation in
accordance with the customary fees in effect at the time of my death.
ITEM IX: I appoint my daughter, CYNTHIA B. PETRY, as Executrix
of this my last will .
ITEM X: No fiduciary acting hereunder shall be required to
post bond or enter security for the faithful performance of his or
her duties in any jurisdiction.
