WHEREAS, Olde Forge Builders-Newville Inc. of Mechanicsburg,
Pennsylvania (herein "Owner") have entered into a contract, with Hampton Construction
Ltd of Cumberland County, Pennsylvania (herein "Contractor"), for the development of
property on Phases II and III, North Newton Hills, Newville, North Newton Township,
Cumberland County, Pennsylvania.
NOW, February 14, 2005, at the time of and immediately before
construction pursuant to such principal contract, and before any authority has been
given by the said Owner Olde Forge Builders-Newville, Inc. to the said Contractor
Hampton Construction Ltd to commence development or purchase materials for the
same in consideration of the making of the said contract with Olde Forge Builders-
Newville, Inc., Owner, and the further consideration of One ($1.00) Dollar in hand paid
to Contractor by Owner Olde Forge Builders-Newville, Inc., it is agreed that no lien shall
be filed against the building by the Contractor, or any sub-contractor, nor by any of the
material-men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.

the place of BEGINNING.
BEING Lot #25 as shown on Phase I of North Newton Hills,
recorded in Plan Book 66, Page 97 on August 9, 1993.
ALSO BEING Phases II and III of North Newton Hills, unrecorded.
BEING part of the premises of which Jay H. Brandt and Lee F.
Brandt, co-administrators of the Estate of Ethel W. Brandt by deed dated
September 22, 1980 and recorded September 25, 1980 in the Office of the
Recorder of Deeds in and for Cumberland County in Deed Book C, Volume 29,
Page 831 granted and conveyed unto James C. Costopoulos, William C.
Costopoulos and William C. Kallas, in fee.
