WAIVEK OF RIGHT TO FILE MECHANICS' LIENS
WHEREAS, DENNIS J. DANKO and BARBARA A. DANKO, his wife, of
43845 Thornberry Square, Unit 110, Leesburg, VA 20176, entered
into a contract with RIDGEVIEW CUSTOM HOMES, LLC, of 946 Ridge
Road, Shippensburg, PA 17257 for the construction of a single-
story dwelling house with attached garage upon a tract of land
known as 1212 Sherwood Drive situate in Third Ward of the Borough
of Carlisle, Cumberland County, Pennsylvania, more particularly
bounded and described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals

EXHIBIT "A"
Waiver of Right to File Mechanics' Liens
ALL THAT CERTAIN tract of land situate in the Third Ward of the
Borough of Carlisle, Cumberland County, Pennsylvania, more
particularly bounded and described according to a Subdivision Plan
entitled "Resubdivision of Lot 32 as shown on final Plan No. 4 of
Notthingham", dated February 1987, revised through March 4, 1988,
and recorded in Cumberland County Plan Book 55, Page 9, as follows:
BEGINNING AT A POINT on the eastern dedicated right-of-way line of
Wellington Drive at the northwest corner of land now or formerly of
John Bowers; thence along the eastern dedicated right-of-way line
of Wellington Drive, North 20 degrees 27 minutes 46 seconds West
129.33 feet to a point on the eastern dedicated right-of-way line
of Wellington Drive with its intersection with the southern
dedicated right-of-way line of Sherwood Drive; thence along said
intersection by a curve to the right having a radius of 20.00 feet
an arc distance of 32.17 feet to a point on the southern dedicated
right-of-way line of Sherwood Drive; thence along the southern
right-of-way line of Sherwood Drive, North 71 degrees, 42 minutes,
38 seconds East 85.52 feet to a point in line of Lot No. 57 as
shown on the "Resubdivision of Lot 32 as shown on Final Plan No.4
of Nottingham", recorded in Cumberland County Plan Book 51, Page
30A; thence by said lot, South 18 degrees 17 minutes 22 seconds
East 150 feet to a point at the southwest corner of said lot in
line of land now or formerly of John Bowers; thence by said land,
South 79 degrees 42 minutes 38 seconds West 100.60 feet to a point
on the eastern dedicated right-of-way line of Wellington Drive,
the point and place of BEGINNING.
CONTAINING 15,423.90 square feet and being designated as Lot No. 56
as shown on Plan entitled "Resubdivision of Lot 32 as shown on
Final Plan No.4 of Notthingham", recorded aforesaid.
KNOWN and numbered as 1212 Sherwood Drive, Carlisle, PA 17013 and
Cumberland County Tax Parcel #04-22-0479-091.
BEING the same premises which Vaunlee E. Cline, widow, by her Deed
dated July 30, 2004, and recorded in the Office of the Recorder of
Deeds in and for Cumberland County in Deed Book 264, Page 2198,
granted and conveyed unto Dennis J. Danko and Barbara A. Danko,
husband and wife.
UNDER AND SUBJECT, HOWEVER, to the provision that all plans and
specifications for any proposed building must be submitted to
Vaunlee E. Cline, or her nominee, for approval as to size, style of
architecture and material to be used; and no construction shall
begin until approval has been given, which approval shall not be
unreasonably withheld, and will be based in part on the conformity
of any proposed building with the size and style of existing
buildings in the area, general character of the area, and commonly
accepted building standards and practices. Approval or disapproval
shall be given in writing within thirty (30) days from the date of
submission of the Plans.
