STIPULATION AGAINST LIENS
THIS AGREEMENT made the 17th day of February, 2005
by and between
HOME DESIGNS UNLIMITED, LLC
hereinafter referred to as Contractor,
AND
HOME DESIGNS UNLIMITED, LLC
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, at LOT #19" THE VILLAGE OF CROSS CREEK, NORTH MIDDLETON TOWNSHIP,
CUMBERLAND CO., PA, more particularly described in attached exhibit ~AH,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar to Contractor it in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by
them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said
Contractor, for themselves, their subcontractors and others under them hereby expressly
waive and relinquish the right to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this instrument, waiving the
right of lien, shall be an independent covenant.

Subdivision Plan for Phase C of the Village of Cross Creek dated 5/28/04 and
recorded 5/28/04 in the Office of the Recorder of Deeds in and for Cumberland
County in Plan Book 89, Page 17, more particularly bounded and described, as
follows:
BEGINNING at a point on the western right-of-way of Pine Creek Drive, said

distance of 107.87' to a point on the southern right-of-way of Roaring Creek
Court; thence, along the right-of-way by a curve to the right having a radius of

distance of7.51' to a point; thence, along the intersection of Roaring Creek Court
and Pine Creek Drive by a curve to the right having a radius of 11.00', an arc
length of 15.59' and a chord bearing of S 00023'01" W with a chord length of
14.32' to a point; thence, along the right-of-way of Pine Creek Drive by a curve to
the left having a radius of 225 .00' , an arc length of 78.69' and a chord bearing of S
30058'37" W with a chord length of78.29' to a point, the place of BEGINNING.
Containing 14,955 sq. ft. (0.34 acres)

BEING THE SAME PREMISES which Penta~Star Investments, Inc. by
