AND NOW, comes Plaintiff, Julie Phillips, by and through her attorneys, Metzger,
Wickersham, Knauss & Erb, P.C., and states the following cause of action and in support thereof,
avers as follows:
Plaintiff, Julie Phillips, is a adult individual having her primary residence at
441 Crossroads School Road, Carlisle, Cumberland County, Pennsylvania
2. Defendant Jim King is an adult individual, with his principal residence at,
8 Goodhart Street, Walnut Bottom, Cumberland County, Pennsylvania.
3. Defendant Mary King is an adult individual, with her principal residence at,
8 Goodhart Street, Walnut Bottom, Cumberland County, Pennsylvania.
4. Plaintiff is the owner of a single family dwelling and surrounding property located
at 1836 Pine Road, Newville, Cumberland County, Pennsylvania (the "Property").
Defendants leased the Property from Plaintiffs from October 2000 until January
2005.
6. The lease agreement between Plaintiff and Defendants was a month to month oral
lease.
Under the lease, Defendants agreed to pay Plaintiff $950.00 per month rent from
July 2004 until January 2005.

8. Defendants vacated the property on or about January 28, 2005.
9. Defendants owe to Plaintiff for rent for the period of January 2005 in the amount of
$950.00.
10. Defendants have not paid the Plaintiff rent due to Plaintiff for January 2005.
11. Late fees accumulate on the unpaid balance at the rate of $5.00 per day.
12. Despite repeated demands, Defendants have refused, and continue to refuse the
monies due to Plaintiff for rent and late fees in connection with rent on the property for January
2005.
13. Defendants paid to Plaintiff a security deposit in the amount of $700.00 on or about
December 2000.
14. Defendants caused damage to the property during the course of the lease in the
amount of $2,600.98. An estimate for the repairs to the property are attached hereto as Exhibit A.
15. The damages Defendants caused to the property include:
a. smoke damage to the walls and ceiling;
b. damage to the stove's exhaust fan;
C. window locks removed from windows;
d. Stove is rusted due to neglect; and
e. Holes to the linoleum in laundry room.
16. After applying Defendants' $700.00 security deposit for the damage caused to the
property, Defendants remain liable for the damage listed in Paragraph 15 above in the amount of
$1,900.98. Additionally, Defendants destroyed the carpets in the property by causing burn holes to
be burned into the carpet.

17. The carpet is damaged to the amount of $5,000.00.
18. Defendants are liable to Plaintiff for the destroyed carpet in the amount of
$5,000.00.
19. Plaintiff was caused to spend $100.00 on cleaning products due to the
unreasonable neglect to the property.
20. Defendants are liable to Plaintiff in the amount of $100.00 for the cleaning
products.
21. Plaintiff was caused to rent a carpet cleaning machine at the cost of $100.00 due
to the unreasonable neglect to the property.
22. Defendants are liable to Plaintiff in the amount of $100.00 for the rental of carpet
cleaning machine.
WHEREFORE, Plaintiff, Julie Phillips, respectfully requests this Honorable Court to enter
judgment in favor of Plaintiff and against Defendants, Jim King and Mary King, in the amount of
Eight Thousand Fifty Dollars and Ninety-Eight Cents ($8,050.98), interest on that amount, the
costs of this action and such other relief as the Court deems just and proper.
