COCKLEY ArrIDAVIT OF TREATING PHYSICIAN If Gary Luttermoser, M.O., the general treating physician at pinnacle Health's Seidle Skilled Nursing Facility, do hereby affirm and state that I am a licensed physician and am currently treating Erma L. Cockley, a resident of Pinnacle Health's Seidle skilled Nursing Facility, in Mechanicsburg, pennsylvania. ! have attended Erma L. cockley since 2000. She had been diagnosed with an early stage of dementia. Since 2000, her condition has deteriorated. Currently, Erma L. (;ockley is totally incapacitated and requires total care from tbe staff at Pinnacle Health's Seidle Skilled Nursing Facility. Her level of mental and social functioning that I have observed consists of resting in bed, and surfClce bleeding of her skin if she is moved. She is severely demented. It is my professional opinion, within a reasonable degree of medical certainty, that Erina 1J. Cockley will continue to suffer ctemen'l;ia and that this proqressive dementia will continue 1.n the future so as to require continual staff care. Further, it is my professional opinion that Erm,;;, L., cockley has no ability to manage her financial resources and that she will not regain her abilities to function without total staff care. Cockley respectfully represents that: 1. petitioner is George W. Cockley, an adult individual who currently resides at 18 San Juan Drive, Mechanicsburg, Pennsylvania. 2. Petitioner's mother, Erma L. Cockley, is an adult individual residing at the Pinnacle Health Seidle Skilled Nursing Facility located 120 South Filbert Street in the Borough of Mechanicsburg, Cumberland County, Pennsylvania. 3. Erma L. Cockley is one hundred and six (106) years of age and an incapacitated female, born on November 15, 1895. 4. Erma L. Cockley has been diagnosed as suffering from dementia and has no capacity to make and communicate decisions. 5. Erma L. Cockley was admitted to the Pinnacle Health Seidle Skilled Nursing Facility on or about November 18, 1994. 6. At the time of her entry to the Pinnacle Health Seidle Skilled Nursing Facility, Erma L. Cockley was admitted by her own consent and without any Power of Attorney document or authority. 7. Erma L. Cockley is a widow and is survived by her only son, George W. Cockley, age 76, Petitioner herein. 8. Gary Luttermoser, M.D., the general treating physician at the Pinnacle Health Seidle Skilled Nursing Facility, has determined that Erma L. cockley is unable to care for herself and in need of a plenary guardian. 9. Erma L. Cockley has no substantial assets or estate, with the exception of a residence dwelling located at 291 Old Stonehouse Road, South, Mechanicsburg, Monroe Township, Cumberland County, Pennsylvania 10. Erma L. Cockley's residence is currently under an agreement of sale and cannot be sold unless a plenary guardian is appointer over her person and estate. 11. Erma L. Cockley's monthly income is limited to approximately ($400.00) per month in the form of a social security benefit and small insurance dividend checks. The remainder of her monthly invoice from Seidle Memorial Hospital is paid for by Medicaid. 12. Erma L. Cockley, because of her physical and mental capacity, is unable to manage her remaining property, lacks sufficient capacity to make or communicate responsible decisions concerning her person and is without the ability to adequately attend to her own safety and welfare. 13. In order to continue to pay for her care and properly dispose of the real estate, it is necessary for the appointment of 2 a plenary guardian over her person and estate. 14. Attached hereto as Exhibit "A" is an affidavit of George W. Cockley showing his willingness to act as plenary guardian of the estate and person of Erma L. Cockley. 15. The proposed Guardian and Petitioner, George W. Cockley, has no adverse interest to the alleged incapacitated person. 16. Pinnacle Health's Seidle Skilled Nursing Facility, by its social Worker, Barbara Ann Isenberg, is not opposed to the appointment of a plenary guardian for Erma L. Cockley in light of the fact that no Power of Attorney exists and no other guardian has been sought or appointed for at the present time. The Guardian will be of your person and/or your money and other property and will have either limited of full powers to act for you. If the court finds you are totally incapacitated, your legal rights will be affected and you will not be able to make a contract or gift of your money to other property. If the court finds that you are partially incapacitated, your legal rights will also be limited as directed by the Court. If you do not appear at the hearing (either in person or by an attorney representing you) the court will still hold the hearing in your absence and may appoint the Guardian requested. COCKLEY PETITION FOR APPROVAL AND AUTHORIZATION TO SELL REAL ESTATE BY PLENARY GUARDIAN TO THE HONORABLE, THE JUDGES OF SAID COURT: Petitioner, George W. Cockley, Plenary Guardian of the person and estate of Erma L. Cockley, by and through counsel of Andrew C. Sheely, Esquire, respectfully states as follows: 1. petitioner, George W. Cockley, is an adult individual residing at 18 San Juan Drive, Upper Allen Township, Cumberland County, Pennsylvania. 2. On May 28, 2002, the Honorable George E. Hoffer, President Judge of Cumberland County, entered an Order of Court appointing George W. Cockley as Plenary Guardian over the person and estate of his mother, Erma L. Cockley. 3. Erma L. Cockley remains totally incapacitated due to severe dementia which renders her incapable of communicating or making any financial decisions. 4. Erma L. Cockley owns all that certain tract of land and improvements thereon located at 291 Old Stonehouse Road, Monroe Township, Cumberland County, Pennsylvania, more particularly described in a deed dated September 20, 1963 as recorded in Deed Book uZ', Volume 20, Page 433 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania. A copy of the deed to the real estate is attached hereto as Exhibit "A". 5. Due to continuing physical incapacities and dementia which restrict Erma L. Cockley to a bed and twenty-four hour care, Plenary Guardian George L. Cockley desires to sell the residence as described above so as to pay for the continuing medical care of his mother, Erma L. Cockley and to eliminate continuing tax obligations and other costs. 6. In April of 2002, George W. Cockley reached an agreement with Patrick L. Peterman to sell the above-described real estate for an amount of $79,900.00 based upon recommendations of a Shirley Mayberry, agent for M. C. Walker, Realty. A copy of the Agreement of Sale is attached hereto as Exhibit "B". 7. After payment of an existing judgment for sewer, outstanding taxes, miscellaneous closing costs and realtor's commissions, Plenary Guardian George W. Cockley anticipates proceeds from the sale of real estate to exceed $66,000.00. 8. The sale of their current residence is necessary and appropriate for the health, safety and welfare of Erma L. Cockley and to pay for outstanding real estate taxes and a sewer judgement on the property which are now well overdue. 9. The sale of their current residence is consistent with fair market values and represents an active listing of the property by a well known realtor for a period of nearly four (4) months. 10. Settlement is presently scheduled for May 30, 2002 in Camp Hill, Pennsylvania. 2 VERIFICATION I, George W.
