MOTION TO SCHEDULED HEARING --
1. On April 14, 2014 the Petitioner filed a Petition to Determine the Disposition of the
remains of Maxwell N. Duesterhoeft.
2. On April 14, 2014 the Petitioner mailed by certified mail return receipt requested a
copy of the Petition to Scott Duesterhoeft, father of decedent.
3. On April 17, 2014 the Court signed a Preliminary Decree directing Scott Duesterhoeft
to show cause why he has the right of Disposition for the remains of Maxwell N,
Duseterhoeft within 20 days of service.
4. On April 23, 2014 Counsel for Petitioner received a copy of the Order to Show
Cause postmarked April 21, 2014.
5. On April 29, 2014 Counsel for Petitioner received the copy of the Petition to
Determine the Disposition of the remains of Maxwell N. Duesterhoeft mailed to Scott
Duesterhoeft marked "refused." Attachment A is a copy of the envelope containing the
Petition.
6. May 13, 2013 is the 20th day since service of the Order to Show Cause.
7. As of the date of this Motion Scott Duesterhoeft has not filed an Answer to show
cause.
WHEREFORE, it is respectFully requested that this Honorable Court grant Petitioner's
request to order a date for the hearing in this matter.
