CLERK OF
OF ORPHANS' COURT
ANNA A. BALLANTINE CUMBERLAND CO„ PA
I, ANNA A. BALLANTINE, domiciled and resident in the
Borough of New Cumberland, Cumberland County, Pennsylvania, and
being of sound and disposing mind and memory, declare that this
document is my Last Will and Testament. I hereby revoke all my
previous Wills, Codicils and Testamentary writings.
PAYMENT OF EXPENSES, DEBTS AND TAXES
I direct my Executrixes to pay medical, funeral and
administrative expenses and all taxes payable by reason of my
death, before any division of my Estate. My Executrixes shall
not attempt to have any part of such taxes apportioned among the
recipients of property includible in determining the amount of
such taxes. Proceeds of insurance on my life, up to the maximum
allowable a an exemption from Pennsylvania Inheritance Tax, and
distributions from pension and profit-sharing plans exempt from
Federal Estate Tax, all of which are payable to a beneficiary
(other than my Estate) , shall not be used to pay debts, taxes,
expenses of administration or other charges against my Estate.
SPECIFIC BEQUESTS
To my daughters, BARBARA A. RUDEWICZ, MARY C. SMEE, and
JUDITH L. ALLEMAN, I specifically bequeath my tangible personal
property, including but not limited to my personal possessions,
furniture, clothing, and household goods, to be divided between
them as they shall agree. If any of my daughters fails to sur-
vive me by thirty (30) days of my death, my surviving daughters
shall share this tangible personal property. If none of my
daughters survive my by thirty (30) days of my death, this tangi-
ble personal property shall be distributed among my residual
beneficiaries in accordance with the terms of this Will. In that
event, the tangible personal property is to be divided among my
residual beneficiaries as they shall agree. If they fail to
reach agreement within sixty (60) days of my death, my
Executrixes shall divide this tangible personal property among my
residual beneficiaries as they determine appropriate, in shares
of substantially equal value.
RESIDUAL BEQUESTS
I give all the rest, residue and remainder of my Estate
and property of whatsoever kind, nature and description, and
wheresoever situated, whether acquired by me before or after the
execution of this Will, whether real or personal, and any
property over which I have the power of appointment, to the fol-
lowing persons, and in the following proportions:
To my daughter, MARY C. SMEE, of Harrisburg, Pennsyl-
vania, I give one-third (1/3) of my residual estate, to enjoy
outright and absolutely.
To my daughter, BARBARA A. RUDEWICZ, of Harrisburg,
Pennsylvania, I give one-fourth (1/4) of my residual estate, to
enjoy outright and absolutely. I also give to my daughter,
BARBARA A. RUDEWICZ, one-twelfth (1/12) of my residual estate, in
trust, for the benefit of Barbara's children, subject to the pro-
visions hereinafter set forth for "Trust A. " This one-twelfth
share shall form the initial corpus of Trust A.
To my daughter, JUDITH L. ALLEMAN, of Shiremanstown,
Pennsylvania, I give one-fourth (1/4) of my residual estate, to
enjoy outright and absolutely. I also give to my daughter,
JUDITH L. ALLEMAN, one-twelfth (1/12) of my residual estate in
trust, for the benefit of Judith's children, subject to the pro-
visions hereinafter set forth for "Trust B. " This one-twelfth
share shall form the initial corpus of Trust B.
Should any of my daughters fail to survive me by thirty
(30) days of my death, her share in my residual estate - with the
express exception of the portions set aside in trust for my
grandchildren - shall be distributed between my surviving daugh-
ters, in equal shares. Nevertheless, the death of any of my
daughters before me shall not affect the distribution of the por-
tions of my residual estate that I have set aside in trust for my
grandchildren; the successor trustee, hereinafter named, shall
carry out the provisions of the trust.
TRUSTS FOR GRANDCHILDREN
These trusts are established for the benefit of my
grandchildren from time to time living who have not attained
twenty-five (25) years of age at the time of my death. Unless
otherwise noted, all of the following provisions shall apply to
both Trust A and Trust B.
2 -
Corpus: The net income shall be accumulated and there-
after treated as corpus in each respective trust. The children
of my daughter, BARBARA A. RUDEWICZ, shall enjoy and share in the
corpus of Trust A, as heretofore mentioned. The children of my
daughter, JUDITH L. ALLEMAN, shall enjoy and share in the corpus
of Trust B, as heretofore mentioned.
Distributions: From the corpus of the trust, the
Trustee shall pay from time to time to or for the benefit of such
one or more beneficiaries such various amounts as are , appropri-
ate, in the discretion of the Trustee, for education (defined as
four years of college, or equivalent preparation in business,
technical or trade training) if the beneficiary strives therefor
in good faith.
when each beneficiary attains the age of twenty-five
(25) years, the Trustee shall pay to him the share to which he
would be entitled if the then existing trust fund were dis-
tributed to my issue then living, per stirpes, on the hypothesis
that my only issue then living are such beneficiary and all
younger beneficiaries of this trust.
This trust shall terminate when the youngest benefi-
ciary attains the age of twenty-five (25) years. If this last
beneficiary dies before attaining that age, then upon his death
Trustee shall distribute the fund to my issue then living, per
stirpes.
If, at the end of my accounting period, the current
market value of the corpus of the trust does not exceed Five
Thousand Dollars ($5,000) , the corpus shall forthwith be paid to
the beneficiaries of the trust then living, per stirpes (my chil-
dren to be the stocks) ; provided that if a distributee is a minor
his share shall be paid to, and held, administered, and dis-
tributed by the Trustee as Custodian for any such minor under the
Revised Uniform Gifts to Minors Act as that Act exists at the
execution of this will and, for this purpose, that Act is incor-
porated by reference.
If this trust is still in existence on the date that is
twenty one (21) years after the death of the last to die of my
issue living at my death, Trustee shall divide the fund, per
stirpes, among the then beneficiaries of the trust (my children
to be the stocks) . The share of each beneficiary shall be paid
to him, provided that the Trustee shall hold, administer, and
distribute the share of any distributee who then is a minor as
Custodian in accordance with the proviso in the last preceding
paragraph.
Trustees: I nominate, constitute and appoint BARBARA
A. RUDEWICZ as Trustee over Trust A. I nominate, constitute and
appoint JUDITH L. ALLEMAN as Trustee over Trust B. In the event
either Trustee is unable or unwilling to serve, I nominate, con-
stitute and appoint MARY C. SMEE, as the successor Trustee of
both Trust A. and Trust B. Neither my Trustees nor successor
- 3 -
Trustee shall be required to file a bond, inventory, or account-
ing with the clerk of court having jurisdiction over this Will.
EXECUTRIXES
I nominate, constitute and appoint my daughters,
BARBARA A. RUDEWICZ, MARY C. SMEE, and JUDITH L. ALLEMAN, as
Executrixes of this Will, to serve without bond. If any does not
survive me, declines to act or, having qualified, resigns, dies
or is removed, the surviving daughters shall serve as
Co-Executrixes in her absence. I give my Executrixes full power
to do any and all things necessary and proper for the full and
complete administration of my Estate, including by not limited to
