THIS AGREEMENT, made this n� day of May, 2014, by and between
HOFFMAN'S CUSTOM CONTRACTING, INC., of 35 Chelsea Lane, Carlisle,
Pennsylvania 17015, hereinafter referred to as Contractor,
AND
ANNA GRIGORYEVA and PAUL M. JOSEPH of 651 Elm Circle, Harrisburg,
Pennsylvania, 17111, hereinafter referred to as Owners, whereby the former
undertook and agreed to erect and construct a dwelling on that certain lot of ground
situate at 395 High Mountain Road, Shippensburg, Cumberland County,
Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH, that said
Contractor,for an in consideration of the sum of One ($1.00) Dollar to it in and paid by
Owners, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid,for itself and its subcontractors, and all parties
acting through or under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said buildings and the
lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise,for,towards, in, or
about the erection and construction of the said dwelling on the lot above described,
and the said Contractor, for themselves,their subcontractors and others under them
hereby expressly waive and relinquish the right to have, file and maintain any
mechanic's liens or claims against the said buildings or any of them, and agree that
this instrument, waiving the right of lien, shall be an independent covenant.

All of that certain tract of land located in South Newton Township, Cumberland
County, Pennsylvania, identified as LOT NO. 7 on a titled Final Subdivision Plan for Jambeth
Investments, L.L.C., prepared by Light-Heigel &Associates, Inc., dated July 3, 2008, Drawing
No. 06-0266, being a portion of the lands now or formerly of Jambeth Investments, L.L.C.,
described in Deed Book 266 at Page 2500 being more particularly described as follows:
BEGINNING at a point in the centerline of Horse Killer Road (T-355) 50 feet wide
and at the southernmost corner of Lot No. 5 as shown on said Final Subdivision Plan in South
Newton Township, Cumberland County, Pennsylvania; thence along the eastern line of said
Lot No. 5 the following three (3) courses and distances: 1) North 49 degrees 6 minutes 24
seconds East 156.08 feet to a point; 2) North 23 degrees 26 minutes 6 seconds East 291.51
feet to a point; 3) North 73 degrees 7 minutes 21 seconds East 80.00 feet to a point in the west
line of the land now or formerly of Donald C. Hershey and Mary Ann Hershey as described in a
deed recorded in Book V Volume 31 Page 510; thence along the west line of said Hershey
tract and the lands now or formerly of Keith A. Glass and Ruth Glass as described in a deed
recorded in Book 252 at Page 4123 and Plan Book 46-26 South 16 degrees 52 minutes 39
seconds East 637.27 feet to a point in the centerline of the aforementioned Horse Killer Road
with the intersection of High Mountain Road (T-366), 50 feet wide; thence along the centerline
of said High Mountain Road the following (4) courses and distances; 1) North 63 degrees 2 r
minutes 47 seconds West 115.82 feet to a point at the beginning of a curve to the left; 2) along
the arc of said curve to the left having a radius of 500.00, central angle of 7 degrees 23
minutes 55 seconds an arc length of 64.57 feet and a chord bearing and distance of North 66
degrees 44 minutes 45 seconds West 64.52 feet to a point; 3) North 70 degrees 26 minutes 43
seconds West 286.31 feet to a point at the beginning of a curve to the right; 4) along the arc of
said curve to the right having a radius of 150.00 feet a central angle of 29 degrees 33 minutes
7 seconds an arc length of 77.37 feet and a chord bearing and distance of North 55 degrees
40 minutes 9 seconds West 76.51 feet to the point of BEGINNING. CONTAINING 98,826
square feet or 2.269 acres (west tract) and containing 6,481 square feet or 0.149 acres (east
tract), excluding that portion of a herein described land contained within the right of way of
Horse Killer Road and High Mountain Road.
