LAST WILL AND TESTAMENT OF JAMES H. POWELL
I,JAMES H. POWELL, unremarried widower, currently of 6704 Lehigh Avenue,
Harrisburg, Swatara Township, Dauphin County, Pennsylvania, being of sound and disposing
mind, memory and understanding, do make, publish and declare this my Last Will and Testament,
hereby revoking and making void any and all prior Wills and Codicils by me at any time
heretofore made.

I give, devise, and bequeath the sun of Five Hundred($500.00)Dollars to my-da4liter, s rn o ay

SANDRA ANN POWELL. In the event she predeceases me,then this specific bequest shall lapse 1

and become part of the residue of my Estate.

All the rest, residue and remainder of my Estate, real, personal and mixed, whatsoever
and wheresoever situate, I give, devise, and bequeath to be divided and distributed as follows:
A. Ninety (90%) percent to my son, JAMES H. POWELL, JR.

In the event that he predeceases me,then to his issue,per stirpes. In the event any
of his issue are under the age of eighteen (18)years at the time of my death, then I appoint
my daughter-in-law, LYNNETTE R. POWELL, Trustee, in Trust for the benefit of him or
her. My Trustee is hereby directed to establish Trust accounts at a bank or financial
institution, brokerage house, or a combination of the same, as she deems best. She is to
hold and invest the assets in good and safe income producing investments.
Upon the attainment of age eighteen (18) by each beneficiary,the principal and any
income accumulated thereon shall be paid over to each recipient outright and absolutely.
In the event my said son, JAMES H. POWELL, JR., predeceases me and has
no surviving issue, then to my son, MICHAEL J. POWELL.
B. Ten (10%) percent to my son, MICHAEL J. POWELL.
In the event that he predeceases me, then to his issue,per stirpes. In the
event any of his issue are under the age of eighteen(18)years at the time of my death,then

I appoint my daughter-in-law, RACHEL HAMELERS, Trustee, in Trust for the benefit of
him or her. My Trustee is hereby directed to establish Trust accounts at a bank or financial
institution, brokerage house, or a combination of the same, as she deems best. She is to
hold and invest the assets in good and safe income producing investments.
Upon the attainment of age eighteen(18) by each beneficiary, the principal and any
income accumulated thereon shall be paid over to each recipient outright and absolutely.
In the event my said son, MICHAEL J. POWELL, predeceases me and has
no surviving issue, then to my son, JAMES H. POWELL, JR., or if he has
predeceases me then to his issue,per stirpes, as the case may be.

It is my intention that beneficiaries named before or after the date of this Will on my
life insurance, annuities, individual retirement accounts (IRAs), in Trust for or joint bank
accounts and any other assets for which I may designate beneficiaries will receive such
investments and that my Will provisions shall not control such investments.
5.
In the event that anyone shall undertake to contest this, my Last Will and Testament, in
any way, form, or manner whatsoever, I direct that any share to which he/she /they may be
arguably entitled shall be forfeited and shall be divided and distributed among the other
beneficiaries in the proportions as set forth above. I further direct that, insofar as I am legally
authorized to do so, my said Executor and his counsel are to seek the payment of any attorney's
fees and court costs incurred in a defense of this, my Last Will and Testament, from such contest
or similar proceeding.
5.
I nominate, constitute and appoint my son, JAMES H. POWELL,JR., to be the
Executor of this my Last Will and Testament. In the event that he is unable or unwilling to
act as Executor, I appoint my daughter-in-law, LYNNETTE R. POWELL,to be Executrix in
his place and stead. In the event she is unable or unwilling to act as Executrix, I appoint my
son,MICHAEL J. POWELL, to be Executor in her place and stead. In the event that he is
unable or unwilling to act as Executor, I appoint my grandson, WILLIAM P. POWELL,to
be Executor in his place and stead, provided he has attained the age of eighteen (18) years. I
further direct that they shall not be required to file bond or other security in the Office of the
Register of Wills for the purpose of administering my Estate.
