SPANGLER KNOW ALL PERSONS BY THESE PRESENTS, that I, ROBERT T. SPANGLER,presently of 104 Longwood Drive, Mechanicsburg, Cumberland County Pennsylvania,being in good health and of sound and disposing mind and memory, do hereby make, declare and publish this as my Last Will and Testament hereby revoking all Wills and Codicils previously made by me. I declare that I am an unmarried woman and that I have no children. ARTICLE I FUNERAL EXPENSES A. My funeral and burial arrangements have been made through the Heller Funeral Home in Lewistown, Pennsylvania, where I have a pre-paid family burial plot. Heller Funeral Home has been designated as a beneficiary on my life insurance policy, which should be sufficient to pay for all just expenses of my funeral and burial. B. The chain that I wear around my neck containing my St. Jude Medallion is to remain upon my neck and be buried with me upon my death. I C. I direct that all the expenses of my last illness and funeral be paid by my Executor from my estate as soon after my death as conveniently may be done. ARTICLE II SPECIFIC BEQUESTS I give and bequeath the sum of TWO HUNDRED ($200.00) DOLLARS to the SACRED HEART OF JESUS CATHOLIC CHURCH of Lewistown, Pennsylvania to be used for one Mass each month for twenty(20) months in honor of the deceased members of my family. ARTICLE III REAL PROPERTY I give, devise and bequeath any and all real property that I own at the time of my death, together with all insurance on such real property, to my dear friend, DAVID J. WAGNER, of Mechanicsburg, Pennsylvania. Should DAVID J. WAGNER predecease me or fail to survive me by thirty (30) days, then any and all real property that I own, together with all insurance on such property, shall pass to my niece, DAWN MARIE COHN, presently of Red Lion, Pennsylvania. 2 ARTICLE IV PERSONALTY A. I give and bequeath all of the items of my household furnishings and tangible personal property identified in the most recently dated separate writing in existence at my death, which is signed by me and describes the items given with reasonable certainty, to the persons specified in that writing. It is to be conclusively presumed that I have left not separate writing if one has not been found by or delivered to my Executor within sixty (60) days after my death. B. I give and bequeath all of my household furnishings and tangible personal property not effectively disposed of by any separate writing referred to above nor elsewhere in this Will (whether by omission or because I have left no valid separate writing), to my dear friend, DAVID J. WAGNER,provided he survives me by thirty (30) days. Should DAVID J. WAGNER predecease me or fail to survive me by thirty (30) days, then all of my household furnishings and tangible personal property shall pass to my niece, DAWN MARIE COHN. ARTICLE V AUTOMOBILES I give and bequeath any and all automobiles that I own at the time of my death, together with all insurance thereon, to my dear friend, DAVID J. WAGNER, provided he survives me by thirty (30) days. Should DAVID J. WAGNER predecease me or fail 3 to survive me by thirty (30) days, I give and bequeath my automobiles to my niece, DAWN MARIE COHN. ARTICLE VI RESIDUE I give, devise and bequeath the rest, residue and remainder of my estate, whether real,personal or mixed, of any nature whatsoever and wherever situated, including any lapsed or void legacy, to my dear friend, DAVID J. WAGNER provided he survives me by thirty (30) days. Should DAVID J.WAGNER predecease me or fail to survive me by thirty (30) days, then I give the rest,residue and remainder of my estate to my niece, DAWN MARIE COHN. ARTICLE VII EXECUTRIX A. I appoint my attorney, MINDY S. GOODMAN, Esquire, as the Executrix of this Will. In the event of her death, resignation, renunciation or inability to act in that capacity, then I appoint my dear friend, DAVID J. WAGNER in her place and stead. B. No bond or other security shall be required of any Executrix or Executor appointed in this Will. a ARTICLE VIII SURVIVAL If any provision of this Will or of any codicil thereto is held to be inoperative, invalid or illegal, it is my intention that all of the remaining provisions thereof shall continue to be fully operative and effective so far as it is possible and reasonable. ARTICLE IX SPECIFIC EXCLUSION I specifically exclude all of my nieces and nephews, except DAWN MARIE COHN, as beneficiaries of my estate. I include this provision not as a means of hurting or offending my nieces and nephews,but strictly as an indication that my failure to include them as beneficiaries is by choice and not an oversight on my part.
