Pykosh, Esquire, and files the following municipal claim against Michael S. Martin and Sherri A. Martin, owning property located at 1288 High Street, Boiling Springs, Pennsylvania 17007. Michael S. Martin and Sherri A. Martin, are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: TRACT NO. 1: ALL THAT CERTAIN lot or piece of ground situate in The Village of Churchtown, Monroe Township, County of Cumberland, Commonwealth of Pennsylvania, bounded and described as follows: FRONTING South on High Street; on the West on lot N/F of William Diller's heirs; on the North on an alley; and on the East on lot N/F of Harvey Rinehart (formerly Lot No. 1 in Plan of Lots). CONTAINING 33 feet in front and 159 feet, more or less, in depth and having thereon erected a two -story frame dwelling house and outbuildings, with mailing address of 1288 High Street, Boiling Springs, Pennsylvania 17007. TRACT NO. 2: *41.5o�n ray 0/51(03 P� 3 &W7 ALL THAT CERTAIN lot or piece of ground situate in The Village of Churchtown, Monroe Township, County of Cumberland, Commonwealth of Pennsylvania, bounded and described as follows: BEGINNING at the southeastern corner of Tract No. 1 herein, thence by High Street, East 33 feet to lands N/F of Paul D. Krissel, et al.; thence by said lands N/F of Paul D. Krissel, et al., North 159 feet to an alley fence; thence West along said alley 33 feet to Tract No. 1 herein; thence South along the same 159 feet, more or less, to the place of BEGINNING. CONTAINING 33 feet in front along the northern line of High Street and extending northwestwardly therefrom at an even width 159 feet more or less to an alley. BEING THE SAME PREMISES which Earl D. Garman and Frances C. Garman, husband and wife, by Deed dated July 8, 2011 and recorded August 30, 2011 at the Recorder of Deeds Office in Cumberland County, Pennsylvania, as Instrument Number 201124112, granted and conveyed unto Michael S. Martin and Sherri A. Martin, husband and wife. TAX PARCEL NO. 22-28-2401-059 Monroe Township Municipal Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from through and including. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02 -04, same being known as a Resolution of the Board of Monroe Township Municipality Authority imposing user charges to be collected from the owner of each improved property served or to be served by the Authority's sewer system, in conjunction with all prior relevant Resolutions and Ordinances, including, but not necessarily limited to, Monroe Township Ordinance No. 3 of 1978 and Monroe Township Ordinance No. 99 -6, as amended; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to for sewerage due to be treated from October, 2013 through January, 2014, which services total is in the amount of four hundred ten and 00 /100 ($410.00) dollars, which sum was duly assessed against, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10 %) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above - described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). The Aareement states that you are responsible ble to pay a minimum of $100.00 per month on the arrears and also keep up with the amount billed for the current quarter. To date we have received several payments from you covering October 2013 through January 2014, which total $657.00. According to our records you have not kept up with the Agreement terms. Therefore, within five (5) days from the receipt of this notification you are required to resume the payment arrangements stated in the Payment Agreement and pay the outstanding agreement amount of 410.00, or the Authority will resume the lien process against your property. Filing of a lien will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed at the current rate. The imposition of assessment of attorney's fees may be avoided by you resume your Payment Agreement within five (5) days of the receipt of this letter.
