On May 27, 2011, Judge Hess appointed the Cumberland County Agin�r� '�3 � -�u ��
Community Services Permanent Plenary Guardian of Person and Estate fc�Lavita�'`� � m
Nickel. Prior to the guardianship hearing, Lavita was taken by Aging St a�f to a Do�est� °
Violence shelter because she had been assaulted by her grandson. She was later
transported to Claremont Nursing and Rehab Center because she required more care
than the shelter could provide. At the time of the hearing, Ms. Nickel was still a resident
of the Claremont Nursing Rehabilitation Center where she continues to reside.
At the time of her admission, her diagnoses were insulin dependent diabetes,
neuropathy, acute anxiety, chronic paresthesias of extremities, hypothyroidism,
hypertension, dermatitis. Since then she has been diagnosed with depression,
dysphasia, dementia, gait dysfunction, weakness, left intertrochanteric hip fracture with
repair, agitation, arteriosclerotic disease, macular degeneration, and urinary tract
infections.
She has chronic issues with cellulitis on her legs which is treated with steroids. There
are times when her blood sugar varies greatly and the staff adjusts her insulin
appropriately.
She continues to enjoy wheeling around the unit and caring for her "babies" which are
several dolls that she likes to hold as well as try to feed. About the only things she will
eat are sandwiches and occasionally warm cereal, but also enjoys the special
supplements that she gets 3 times a day.
As in the past, her behavior continues to be disruptive at times. She goes into other
residents' rooms and behind the nurses station. In July 2013 she twisted a male
resident's leg and it had to be x-rayed. Another time she bent an aide's finger back
when she tried to calm her down. The doctor has tried various changes in her mood
stabilizing medications to keep these to a minimal.
She is visited every 30-60 days by Cumberland County Aging staff. She was also taken
birthday and Christmas presents.

It is the request of Cumberland County Aging that the agency retain Guardianship of
Person. Claremont Nursing and Rehab has demonstrated an adequate quality of care
for her medical problems. We believe, therefore, that Ms. Nickel should continue to
reside in that nursing facility.
Guardian of Estate
At the time of the guardianship, Ms. Nickel had a checking account at Adams County
National Bank in Newville, PA with a balance of$2625.14. This account was later
closed and a guardianship account was opened at F&M Bank.
Her only income is Social Security which is currently $1175. The monthly amount paid
to Claremont Nursing and Rehab Center is approximately $1040.00 a month.
Cumberland County Aging is paid $100 a month for a guardianship services as
provided by the court order.
Attached is a financial summary of LaVita Nickel's income and expenses. Also attached
is a spread sheet representing her checking account register.
