PETITION FOR SPECIAL RELIEF FOR RETURN OF PROPERTY
AND NOW, this 5th day of June 2014 comes the Plaintiffs, Nina Krakovitz and files the
following petition for Special Relief, and in support thereof, avers as follows:
1. Plaintiff, Nina Krakovitz currently receives mail at PO Box at 661, Carlisle, PA 17013.
2. Defendant Courtney Spitler currently resides at 809 Good Hope Road,
Mechanicsburg PA 17050.
3. Plaintiff Krakovitz and Defendant Spitler are former coworkers.
4. Plaintiff Krakovitz and Defendant Spitler allegedly had a verbal agreement whereby
5. Plaintiff Krakovitz would reside at 809 Good Hope Road residences on a monthly
basis.
6. Plaintiff Krakovitz moved into the Good Hope residence on or about September 10,
2013.
7. At some point, Defendant Spitler indicated she was going to be residing at the 809
Good Hope Road, residence.
8. Plaintiff Krakovitz moved out of the Good Hope residence approximately January 10,
2014.
9. During the course of moving out of the residence, Defendant Spitler called Hampden
Twp. Police.
10. Plaintiff Krakovitz still has many of her personal belongings in the garage located at
809 Good Hope Road. A list of belongings, but not limited to those listed are
believed to be in the Defendants Spitler's possession, is attached as Exhibit "A".
11. Upon information and belief, Defendant has erroneously indicated that Plaintiff
"owes her" and is refusing to relinquish Plaintiffs belongings.
12. Plaintiff aver that Defendant is unlawfully withholding personal belongings; in the
event Defendant believes that she is "owed" something, she must take a lawful
course of action and not pursue a course of action that is contrary to the laws of the
Commonwealth of Pennsylvania.

Defendant Spitler to immediately return personal belongings listed on Exhibit "A".

DEFENDANT'S RESPONSE TO RULE TO SHOW CAUSE
AND NOW COMES, the Defendant, by and through her attorneys, the Law Offices of
Peter J. Russo, P.C., and respond to the Rule to Show Cause issued in this matter as follows:
1. Plaintiff (Nina Krakovitz) in this matter filed a Petition for Special Relief for the
Return of Property with this court on June 5, 2014.
2. Prior to the request for special relief, Plaintiff filed an action before Magisterial
District Judge Kathryn Silcox on May 2, 2014, seeking a judgment for the value of
the property subject to the request for special relief.
3. The matter was docketed at MJ -09304 -CV -149-2014.
4. On June 27, 2014, Defendant (Courtney Spitler) filed a Landlord Tenant action
against the Plaintiff for unpaid rent, breach of the lease, and damage to the property
seeking $8,160.26 in damages.
5. The matter was docketed at MJ-09304-CV235-2014.
6. A hearing was held on both parties' claims on August 5, 2014, before Magisterial
District Judge Silcox.
7. On August 8, 2014, Judgment for both matters was entered in favor of Courtney
Spitler. A true and correct copy of the judgment is attached hereto and incorporated
as Exhibit 1.
8. Plaintiff, in this matter, has not filed an appeal on the judgment entered by MDJ
Silcox within the time required under the Pennsylvania Rules of Civil Procedure.
9. Judgment awarded at the MDJ to Courtney Spitler took into account the value of the
property of Ms. Krakovitz that remained in the possession of the Defendant.
10. This matter has been judged on the merits, and therefore, the issue is barred under the
principal of Res Judicata.
11. The Defendant in this matter would be prejudiced should the Court allow this matter
to go forward as the time to file an appeal on the judgment amount has passed.
WHEREFORE, Defendant hereby requests that this Honorable Court deny the relief
requested in this matter.
