Plaintiff, Pennsylvania National Mutual Casualty Insurance Company is a business entity authorized to issue policies of homeowner's insurance in the Commonwealth of Pennsylvania with an address of 2 North Second Street, Harrisburg, Dauphin County, Pennsylvania. 2. Defendant S & R Roofing and Construction, LLC is a construction business with an address of 7210 McClays Mill Road,Newburg, Cumberland County, Pennsylvania. 3. This matter arises from damages that occurred at the home of Kevin and Debra Rock, who are insureds of the Plaintiff Penn National with a homeowner's policy, in January 2014. {00702035;vl} 4. The Rocks had hired Defendant S & R Roofing to place a new roof on their home at 340 West Meadow Drive, Mechanicsburg, Pennsylvania in 2013 and that work was performed. 5. The roofing work was performed in a negligent manner, including the failure to close a radon vent cap, resulting in water entering into the home of the Rocks, causing damage including the development of mold. 6. The negligence of Defendant S &R Roofing included: a. Loosening a radon vent cap and failing to close same; and b. Performing the roofing repairs such that water was allowed to enter into the home of the Rocks 7. As ' a result of the aforesaid negligence, Plaintiff's home incurred damages, including the development of mold, necessitating repairs at a total cost of$9,970.61 8. Kevin and Debra Rock presented a claim for these damages to Plaintiff Pennsylvania National, which has paid the claim under their homeowner's coverage and pursues the present action in subrogation against the responsible party.
