COMPLAINT
1. Plaintiff Metropolitan Group Property and Casualty Insurance Company is
an insurance company licensed and authorized to conduct business in the
Commonwealth of Pennsylvania and having as one of its principal places of business
the above captioned address.
2. Kathleen A. Weed and George E. Weed were adult individuals insured
with Metropolitan Group Property and Casualty Insurance Company,under a
personal automobile policy.
3. Defendant New England Motor Freight, Inc. (hereinafter NEMF) is a
business entity having as one of its principle places of bilsiness the above captioned
address.
4. Defendant Muniru Iddris is an adult individual residing at the
above captioned address.
5. On or about 05/10/2013 Plaintiff Metropolitan Group Property and
Casualty Insurance Company insured the Weeds with a personal auto policy,policy
number 3692727040, said policy covering a 2009 Chevrolet Tahoe and carrying with
same collision and rental coverages.
6. On or about 05/10/2013, Defendant, Muniru Iddriss,while operating a 2008
Volvo VNM (NJ tag#AL840E), was acting as agent, servant, employee and/or
workman and/or for the common purpose of Defendant NEMF Trucking Inc.
7. On or about 05/10/2013, near mile marker 057 of Interstate 81 North of
in Silver Spring Township, Cumberland County, Pennsylvania, Defendant Muniru
Iddriss while operating the aforesaid 2006 Volvo VNM,NJ tag#AL840E, did
negligently, carelessly and/or recklessly, strike/collide into Plaintiff's insured's
vehicle in the rear causing extensive damages to same.
8. The negligence of the Defendants consisted of:
a) negligent entrustment;
b) failing to exercise due care;
c) being inattentive;
d) failing to maintain proper lookout;
e) failing to maintain control of said vehicle so as to be able to stop within
the assured clear distances ahead;
f) failing to give due regard to the right, safety,point and position of
plaintiffs property;
g) driving too fast for conditions;
h) following too closely;
i) other such negligence developed through continuing discovery and trial
of this matter.
9. The aforesaid collision resulted solely from the negligent acts and/or
failure to act on part of Defendants named herein and was due in no manner
whatsoever to any act and/or failure to act on part of Plaintiff's insured.
10. As a result of the aforesaid collision, Plaintiff's insured's vehicle sustained
extensive damages to same.
11. Pursuant to the aforesaid policy of insurance, Plaintiff Metropolitan Group
Property and Casualty Insurance Company settled the collision and rental claims of
the Weeds in the amount of$31,042.59, (said figure includes Plaintiff's insured's first
party deductible)representing fair and reasonable reimbursement for the damages
sustained.
12. Pursuant to the aforesaid policy of insurance, Plaintiff Metropolitan Group
Property and Casualty Insurance Company is subrogated to Bryan E. Weed & Tricia
L. Weed, as co-executors of the Estate of Kathleen A. Weed and the Estate of
George E. Weed for this loss.
WHEREFORE, Plaintiffs demand judgment against Defendants jointly and
severally in the amount of$31,042.59 together plus costs, interest and such other
relief this Court finds equitable and just.
