Jirard, pursuant to the Rules of Court of the Ninth Judicial District, Cumberland County, Pennsylvania, and who hereby attests and avers to be true, and respectfully requests the name change of her minor child, GIANNA MORGAN JIRARD, to GIANNA MORGAN LoBUONO, for the following reasons: 1. Petitioner adopted minor child on April 29, 2008, (see certified copy of final decree attached hereto as Exhibit 1). The decree was granted by Judge Oler of this Honorable Court (retired). 2: The adoption was a single-parent adoption and Petitioner is the sole legal custodian and guardian of minor child (see certified copy of certificate of adoption attached hereto as Exhibit 2). 3. Petitioner adopted the minor child to save the child from her birth parents, Mark Battista and Lisa DeFelice, who were unfit. Both parents remain in and out of jail in Massachusetts and have had little to no contact with the child for years. 4. The minor child is actually Petitioner's first cousin once removed. Petitioner's mother Lillian R. (Morgan) Jirard is the older sister of the minor child's grandmother, Laura c-) = (Morgan) Battista. From a young age, the child's primary maternal figure was her paternal aunt Jennifer(Battista) LoBuono in Saugus, Massachusetts. The child's bix�l ' I>C-,CD r, w , '' 07 Sap 4 father would disrupt the child's life by taking physical custody of her to obtain welfare benefits; he would then abandon the child back to his sister's care, Jennifer (Battista). 4. The decision to adopt the minor child was a Battista-Jirard family decision made in the minor child's best interest to prevent Mark Battista from using the child for money. 5. Since Petitioner has become the legal mother of the child, Petitioner has enlisted the aid of many mental health specialists to assist the child in adjusting to her new family. Petitioner has two other adopted children who, along with Petitioner, are African American. The minor child is White. The child remains close with her grandmother and aunt, Laura and Jennifer (Battista). 6. The mental health professionals who since 2007 have treated the minor child with her family adjustment issues are: Joan Larkin Drake, PhD, RN (Carlisle, PA): Shippensburg University Graduate Counseling Program (Shippensburg, PA); Dr. Mark N. Heinly, MD, psychiatrist (Lemoyne, PA); and, most recently Georgi Anderson, licensed therapist (Carlisle, PA). 7. The Morgan-Battista-Jirard-LoBuono family has now,decided, after reflection upon the collective therapeutic assessments, that it is in the minor child's best interest if she physically returned to live with her"first mother" figure, Jennifer(Battista) LoBuono. Petitioner remains solely legally and financially responsible for the minor child while the LoBuono family has physical custody in West Palm Beach, Florida. 8. To restore the minor child's sense of connection and emotional well being with her natural family, Petitioner respectfully requests to change of her minor child, GIANNA MORGAN JIRARD to GIANNA MORGAN LoBUONO.
