For dates of death on or after July 1, 1994 and before Jan.1,1995,the tax rate imposed on the net value of transfers to or for the use of the surviving spouse
is 3 percent(72 P.S.§9116{a)(1.1)(i)].
For dates of death on or after January 1, 1995,the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S.§9116(a)(1.1)(ii)j. The statute does not exempt a transfer to a surviving spouse from tax,and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary. �

1. I direct the payment of all my just debts and funeral expenses as soon as
may be convenient after my decease.
2 a. I hereby give and bequeath, absolutely and in fee simple, to my spouse
Marlin L. McLaughlin, all my household furniture and furnishings, books,
pictures, jewelry, china, linen, silvercvare, automobiles, �vearing apparel and
all other articles of household or personal use or adornment, including
insurance policies thereon, provided that if iny spouse dies before the
thirtieth (30th) day follo�ving the day of my death, this gift shall lapse or be
divested and I make said bequest to my children according to the terms I set
forth belo�v.
2 b. T11e gift to my spouse in Item 2a aUove is intended to give my estate the
marital deductian effective under the Internal Revenue Code to reduce
Federal estate tax. Any provisions in this Wiil �vhich confiict �vith or tail of
this intention shall be so reconciled or amplified as to accomplish this
objective.
3 a. If n1y spouse, i�l�rlin L. IVIcLaughliil, survives ine, I direct that my
Trustee, hereinafter named, hold, Ii�,T TRUST, an amoLint free of all taxes
equal to the maximum marital deduction allo�vable to my estate for Federal
Estate tax purposes, reduced, by an amount, if any, needed to increase my
taxaUle estate to the largest amount that after allo�ving for the unified credit
and any other credits available to iny estate, �vill result in no federal estate tax,

and pay the net income therefrom not less frequently than quarterly to my
spouse for and durin; his nahtral life, `I�� spouse shall have the po�ver to
appoint all or any parts of the principal of this Trust tu himself, his estate, or
to our children. This po�ver shall be exercisable by him alone and in all events
by specific reference thereto in his �'Vill, or by delivery at atry time or times
during his lifetime of a �vritten direction to my Trustee ��-ho shall thereupon
make payment as he directs.
3 b. My trustee shall pay to his personal representatives from any
unappointed principal the ciifference bet�veen all taxes, interest and penalties
�vhich they must pay by reason of his death, and those �vhich �vould be
payable by them if such unappointed principal �vere not taxable in his estate,
and shall add the balance of such unappointed principal to my residuary trust.
4. All the rest, residue and remainder of iny estate, real, personal and
mixed, whatsoever and �vheresoever situated, I give, devise and bequeath to
my Trustee, hereinafter named, IN TRUST, as follo�vs:
(A) The net income therefrom shall be paid to my spouse,
Nlarlin L. IVIcLaughlin, for and during his natltral life.
(B) Upon the death of the survivor of myself and my spouse,
my Trustee shall distribute all the remaining corpus and any
accumulated interest thereon as follo�vs:
One (1) share thereof, in trust, for my son, Darryl M.
McLaughlin, one (1) share to n1y daughter, Dianne Shuey.
Should either of them have predeceased me, and have been
survived by issue, then such share shall go to their issue per
stirpes, �vith the further proviso, that in the event of Darryl's
death, the trust �vill remain for the benefit of Dianne's two
children �vith income annually and principal distributions to be
made to them as follo�vs: 50% at age 25, and 50% at age 30.
Should any one of them have predeceased me and not have
been survived by issue, then their share shall go to their
surviving brother(s) or sister(s) or their issue per stirpes as the
case may be•
5. "I he trustee may use principal of the Trust under Item nuinber 3a,
hereof (I�-'Iarital Deduction Z'rust) only for the benefit of iny spouse; �vith the

foregoing exception my Trustee may use principal from t11e Trust under Item
number 4, hereof (Residue Trust) for the benefit of my spouse and children as
the Trustee deems necessar_y:
� (A) To meet the expense of any accident, illness or other
emergency befalling any of thein;
(B) For maintenance, support and education (including
college and graduate school);
(C) To pay ftuleral expenses, including the cost of a grave
marker and perpetual care of the grave.
Notwithstanding the foregoing, the po�ver to consume, invade or appropriate
property for the benefit of my spouse and children shall be limited by
ascertainable standards relating to health, education, support or maintenance
�vithin the meaning of subparagraph (a) of § 2014(b)(1) of the Internal
Revenue Code of 1954 or any similar provision �vhich may be in effect at the
time of my death so that such power will not constitute a general power of
appointment.
6. If, at the time of my death, circumstances are such that it �vould be
unwise to establish this Trust because fiduciary fees woulc� be too high in
relation to the ainount of available assets or for other like reason or cause,
then this Trust need not be establisheci and this part of my estate (that
designated as the Residue Trust) shall pass to my spouse outright and free of
trust.

appointment, including any pocver of appointment granted me under my
spouse's will.
S. All taxes, interest and penalties thereon payable by reason of my death
with respect to property coinprising my gross estake, �vhether or not passing
under this Will, shall be paid from the principal of my residuary estate,
providecl, ho�vever, that funds of my Trust created herein may be used to pay
taxes, interest and penalties attributed to such trust assets.

9. No interest of any beneficiary ttnder this ��'ill or any Codicil hereto
shall be subject to anticipation or voluntary or involtuztary alienation, and
the personal receipt of such beneficiar}� sh�ll be the sutficient and only
discharge of my executor and Trustee tulless other��-ise provided herein.
10. In addition to po�vers given them by la�v, my Executor V���erfollo�in�
their successors and any guardian acting hereunder shall ha g
discretionary po�vers ap�licable to all real and personal property held t�y them,
effective without court order and until actual distribution:
(A) To retain all property received by them including the

(B) To invest in all forms of property �vithout restriction to
investments authorized to fiduciaries, so long as sLich

authorized to fiduciaries, so long as suc11 investinents are
productive;
(D) To Comproinise controversies;

with reference to marriage, divorce, illness, incapacity or other

(L) To elect to value my gross estate for Federal Estate tax
purposes as of the date of my death or as of the alternate
