COMES NOW thc I'lainti!T, Ethel Taylor, by and through her attorney, Gregory R. Reed,
Esquire. and for hcr causc ofaetion alleges:
[, Ethcl Taylor (hereinafter refcrred to as "Plaintiff') is an adult individual,
presently residing at ns Birch Lane, Carlisle, Cumberland County, Pennsylvania 17013.
2" Austin D" Makowski ( hereinafter refen'ed to as "Defendant"), is a
minor, presently residing at 39 Half Mile Drive, Gardners, Adams County, Pennsylvania,
3, The litcts and occurrences hereinafter related took place on or about August I, 2004
on State Route 34 in Me Holly Springs Borough, Cumberland County, Pennsylvania at
approximately 1:43 jl,Jl],
4, At about that time and place I'laintiffwas the operator ofa 1995 Oldsmobile Cutlass
and was traveling South on State Route 34"
5" At about that time and place Dctendant was the operator ofa 1998 Honda Civic and
was traveling North on Slate Route 34,

(" At about that time and place the vehicle operated by Defendant was caused or
allowcd to travel across the double yellow line into the southbound lane, crashing into the
vehicle driven by PlaintilT
7. Thc at(m~said collision and all the hereinafter mentioned injuries and damages
sustaincd by 1'laintitTare the direct result of the negligence, carelessness and recklessness of
Defendant as follows:
(a) In liriling to keep alert and maintain a proper lookout for
the prcsence of other Illotor vehicles on the highway;
(11) In failing to keep proper' and adequate control of his vehicle;
(e) In liriling to stop his vehicle from coliiding with Plaintiffs vehicle;
(d) In tililing to exercise the degree of care required when operating
a vehicle on a rural route with two lanes separated only by a
double yellow line:
(e) In allowing or causing his vehicle to cross the center double
yellow line;
(I) In operating his vehicle without due regard for the rights,
salCty and position ofPlaintitf's vehicle at the time and place
oCthe aforesaid collision:
(g) In I,riling to maintain a proper lookout for traffic;
(h) In hiling to yield the right of way to Plaintiffs' vehicle;
(i) Inliriling to apply his brakes in time to avoid striking
Plaintitrs vehicle; and
(j) Inliriling to take measures to avoid striking Plaintiffs vehicle.

1\, As a result of the aforesaid collision Plaintiff was thrown and jostled about, thereby
sustaining painful, permanent, severe and disabling injuries and serious impairment of function
including. but not limited to. injuries to her right wrist, right ankle, bruises on her abdomen,
chest and len kg.
9. Plaintitfhas been advised and therefore avers that some or all of said injuries arc
permanent in nature, and claim is made therefore,
10, By reason of the aforesaid injuries sustained by Plaintiffshe is forced to incur the
costs or' medical tre'\lmenl. medicine. physical therapy, and similar miscellaneous expenses in
and about an elYllrl t" reSlllre herselflu hcalth; and because of the nature of said injuries she is
advised, and therefi)re avers, that she will be forced to incur similar expenses in the fiIture, and
claim is made therefore.
II. As a result of said injuries Plaintiff has undergone and in the future will undergo
great mental and physical pain and suffering, grcat inconvenience in carrying out her daily
activities. loss o!,liI'c's pleaslII'es and cnjuyment and claim is made therefore,

WHERFFORE. l'laintif( Ethcl Taylor, demands judgment against the Defendant, Austin
D. Makowski, lor compensatory damages in an amount exclusive of interest and costs in excess
of any jurisdictional amount requiring compulsory arbitration in Cumberland County,
Pennsylvania.
