Galloway, Esquire, and files this Complaint and in support avers as follows: 1. Plaintiff Barbara E. Way is an adult individual with a primary address of 1400 Bent Creek Blvd., Apt. 216, Mechanicsburg, PA 17050. 2. Defendant Edward G. Schwalm is an adult individual with a primary address of 229 E. Main St., Shiremanstown, PA 17011. 3. On or about July 31, 2011, pursuant to a written repayment agreement, Plaintiff extended a $5,000 loan to Defendant. A copy of the repayment agreement is attached hereto as Exhibit "A." 4. Defendant breached the repayment agreement by failing to make payments. 5. Defendant's last payment for $100 was paid to Plaintiff on January 13, 2013. 6. As of the date of this Complaint, the balance due and owing to Plaintiff is $3,794. WHEREFORE, Plaintiff respectfully requests this Honorable Court enter judgment against Defendant for $3,794, plus costs of this action, and any other relief as this Court deems just and reasonable. The loan in the July 31, 2011 contract was for the sale of Joinder Defendant's home, Joinder Defendant's share of the real estate taxes, and Joinder Defendant's debts. 13. Joinder Defendant received the benefit of the contract signed on her behalf by Joinder Plaintiff. 14. Joinder Plaintiff made payments to the extent and for things which represented his liability. 15. Any remaining amount due Plaintiff is solely for debts incurred by the Joinder Defendant. 16. Joinder Plaintiff understood that she obligated to repay the remainder of the loan and refused to do so. 17. Upon information and belief, Plaintiff understood and agreed to this arrangement. 18. The Joinder Defendant should be required to pay over to Plaintiff any additional sum that may and is alleged to be due. WHEREFORE, the Joinder Plaintiff demands judgment against the Joinder Defendant in the amount of $3,794 plus the costs of this action, and any other relief as this Court deems just and reasonable.
