following pages, you must take action within twenty (20) days after this Complaint and Notice

COMPLAINT
Mellott's Disaster Restoration, Inc. d/b/a ServiceMaster of Greater Harrisburg and West
Shore ("ServiceMaster"), by and through its undersigned counsel, for causes of action against
defendants avers as follows:
1. Plaintiff Mellott's Disaster Restoration, Inc. d/b/a ServiceMaster of Greater
Harrisburg and West Shore ("ServiceMaster") is a Pennsylvania corporation with a principal
place of business located at 2506 Boas Street, Harrisburg, Dauphin County, Pennsylvania.
2. Defendant Frank R. Barba is an adult individual who resides at 6 Kelly Drive,
Carlisle, Cumberland County, Pennsylvania.
3. Defendant Cynthia L. Barba a/k/a Cindy L. Barba is an adult individual who
resides at 6 Kelly Drive, Carlisle, Cumberland County, Pennsylvania.
4. On or about October 18, 2013, Mrs. Barba contacted ServiceMaster and requested
an estimate for the repair of soot damage to the Barba residence located at 6 Kelly Drive,
Carlisle, Cumberland County, Pennsylvania.

5. The soot damage was the result of a malfunctioning stove in the kitchen, which,
according to the defendants, had begun to malfunction in 2011.
6. Mr. and Mrs. Barba had previously engaged another contractor to remediate the
damage to their residence, but that contractor had either not completed the work or had been
removed from the job by the Barbas.
7. In cooperation with the Barbas' homeowner's insurer, ServiceMaster offered to
perform services consisting of cleaning portions of the real and personal property and packing of
personal property for storage.
8. On October 30, 2013, ServiceMaster and Mrs. Barba executed a written contract
for cleaning, packing and boxing services (the "Agreement"). A copy of said Agreement is
submitted herewith as Exhibit"A".
9. The scope of the work was set forth in two written estimates for a total of price of
$16,547.54. Copies of these estimates are submitted herewith as Exhibits `B" and "C"
respectively.
10. Pursuant to the Agreement, ServiceMaster agreed to clean the home's ducts, to
spot clean the home's carpets and walls, and to pack personal belongings.
11. Commencing in early November, 2013, ServiceMaster performed the
aforementioned cleaning and packing services at the Barba residence, and completed the work on
or about December 4, 2013.
12. During the course of the work, ServiceMaster learned that the Barbas were boxing
and packing household items themselves in violation of the contract. ServiceMaster did not
authorize or direct the Barbas to box or pack the items.

13. While ServiceMaster was performing the work pursuant to the Agreement, the
Barbas insisted that the carpets must be replaced, despite such replacement not being included in
the Agreement and not being contained in the scope of the work.
14. ServiceMaster performed all of the work under the Agreement as required by the
contract, in good faith, in a timely manner, and in manner which met applicable standards of
workmanship.
COUNT I: BREACH OF CONTRACT
SERVICEMASTER V. CINDY BARBA
15. ServiceMaster incorporates by reference paragraphs 1 though 14 of the complaint
as if set forth fully herein at length.
16. After completion of the work as outlined in the Agreement, ServiceMaster
invoiced Mrs. Barba in the amount of$15,706.89 on December 17, 2013. A copy of this invoice
is submitted herewith as Exhibit"D".
17. Mrs. Barba has made no payments despite repeated demands by ServiceMaster
for the same.
18. Pursuant to the Agreement, Mrs. Barba is liable for the costs of collection,
including, but not limited to attorneys' fees and court costs.
19. Mrs. Barba has breached the contract with ServiceMaster by failing to pay for the
goods and services rendered pursuant to the Agreement, and ServiceMaster has suffered
damages in the amount of$15,706.89 plus collection costs, attorneys' fees and court costs.
WHEREFORE, ServiceMaster demands judgment in its favor and against Cynthia L.
Barba a/k/a Cindy L. Barba in the amount of fifteen thousand, seven hundred and six dollars and
eighty-nine cents ($15,706.89), plus attorneys' fees and court costs, along with interest, costs of
suit, and such other further relief as this Honorable Court may deem appropriate and just.

COUNT II: UNJUST ENRICHMENT
SERVICEMASTER V. FRANK BARBA AND CINDY BARBA
20. ServiceMaster incorporates by reference paragraphs 1 though 19 of the complaint
as if set forth fully herein at length.
21. ServiceMaster performed services under the Agreement at the residence of
Cynthia L. Barba a/k/a Cindy L. Barba("Cindy Barba") and Frank R. Barba("Frank Barba")
located at 6 Kelly Drive, Carlisle, Cumberland County, Pennsylvania(the "Barba Residence").
22. The Barba Residence is owned jointly by Cindy Barba and Frank Barba.
23. Defendant Cindy Barba engaged the services of ServiceMaster; however, both
Cindy Barba and Frank Barba derived a benefit from ServiceMaster's provision of goods and
services without repayment from either defendant.
24. ServiceMaster avers that the value of the aforesaid labor and materials provided to
defendants Cindy Barba and Frank Barba is equal, at a minimum, to fifteen thousand, seven
hundred and six dollars and eighty-nine cents ($15,706.89).
25. ServiceMaster did not intend to confer a gratuitous benefit as to the rendition of
the aforesaid goods and materials, nor should defendants Cindy Barba and Frank Barba have
expected such a gratuity.
26. Defendants Cindy Barba and Frank Barba continue to enjoy unjustly the benefits
conferred by ServiceMaster without payment.

WHEREFORE, ServiceMaster demands judgment in its favor and against Cindy Barba
and Frank Barba in the amount of fifteen thousand, seven hundred and six dollars and eighty-
nine cents ($15,706.89), along with interest, costs of suit, and such other further relief as this
Honorable Court may deem appropriate and just.

Defendants Frank R. Barba and Cynthia L. Barba, by their attorneys, Snelbaker &
Brenneman, P. C. submit this Answer with New Matter to Plaintiffs Complaint as follows:
ANSWER
1. It is admitted only that Plaintiff Mellott's Disaster Restoration, Inc. is a Pennsylvania
corporation with an address as indicated. It is denied that Plaintiff does business as
"ServiceMaster of Greater Harrisburg and West Shore".
2. Admitted.
3. Admitted.
4. It is admitted only that in October 2013 Defendant Cynthia Barba contacted
ServiceMaster and requested an estimate for the repair of soot damage to the residence at 6 Kelly
Drive. The specific date of such contact is presently unknown.
5. Denied. It is denied that said damage was the result of a malfunctioning stove in a
kitchen. On the contrary, the soot damage was the result of the stove in the kitchen being hooked
up improperly for natural gas instead of propane fuel in October 2011.
6. Admitted in part; denied in part. It is admitted that the Defendants had previously
engaged another contractor to remediate the damage to the residence and that contractor did not
complete the work. It is denied that the contractor had been removed from the job by the
Defendants.
7. Denied. It is denied that ServiceMaster's offered services consisted of cleaning
portions of the "real property". On the contrary, ServiceMaster was to clean substantially the
entirety of the Defendants' residence.
8. Admitted.
9. Admitted.
10. Denied. The agreement between Plaintiff and Defendant Cynthia Barba being in
writing speaks for itself. Plaintiff's characterization of the contents of the agreement which is
represented by documents, is denied. It is further denied that the parties agreed to spot clean the
carpets in the home.
11. Admitted in part; denied in part. It is admitted that the work by ServiceMaster
commenced in early November 2013 and ceased on December 4, 2013. During that time

ServiceMaster performed services in the Defendants' residence on ten different dates. It is
denied that at any time Plaintiff completed the work undertaken through the agreement between
Plaintiff and Defendant Cynthia Barba.
12. Denied. It is denied that Defendants boxed and packed household items themselves
in violation of the contract. It is further denied that ServiceMaster did not authorize the
Defendants to box or pack any items. On the contrary, Plaintiff specifically advised Defendant
Cynthia Barba to box her own personal and family items which she did.
13. Denied. It is denied that the Defendants that at any time insisted that the carpets in
the home be replaced.
14. Denied. Paragraph 14 of Plaintiff's Complaint contains an unwarranted conclusion
of law to which no response is required by Defendants. To the extent a response is deemed
necessary, it is denied that ServiceMaster performed all of the work as required by the contract
for the reasons set forth in New Matter, the averments of which are incorporated by reference
herein.
15. The averments of Paragraphs 1 through 14, inclusive, above, of this Answer are
incorporated by reference herein.
16. Admitted in part; denied in part. It is admitted that Plaintiff sent an invoice to
Defendant Cynthia Barba in the amount of $15,706.89 dated December 17, 2013. It is denied
that Plaintiff completed the work as outlined in the agreement for the reasons set forth in New
Matter, the averments of which are incorporated by reference herein.
17. Denied. It is denied that Defendant Cynthia Barba made no payment despite

repeated demands by ServiceMaster for same. It is further denied that ServiceMaster made
repeated demands for payment. On the contrary, on February 10, 2014 payment to Plaintiff was
made in the amount of $1,077.00 by check No. 8325.
18. Denied. Paragraph 18 of Plaintiffs Complaint contains an unwarranted conclusion
of law to which no response is required by Defendant Cynthia Barba. To the extent a response is
deemed appropriate, it is denied that Defendant Cynthia Barba is liable for the costs of
collection, including, but not limited to attorneys' fees and court costs.
19. Denied. Paragraph 19 of Plaintiffs Complaint contains an unwarranted conclusion
of law to which no response is required by Defendants. To the extent a response is deemed
appropriate, Plaintiff is entitled to no recovery of any nature for the reasons set forth in New
Matter, the averments of which are incorporated by reference herein.
WHEREFORE, Defendant Cynthia L. Barba requests that judgment be entered in her
favor and that the claims raised in Count I of Plaintiffs Complaint be denied and dismissed with
prejudice.
20. The averments of Paragraphs 1 through 19, inclusive, above of this Answer are
incorporated by reference herein.
21. Admitted in part; denied in part. It is admitted that Plaintiff attempted to perform
services under an agreement at Defendants' residence at 6 Kelly Drive, Carlisle. It is denied that
Plaintiff completed or properly performed services at Defendants' residence for the reasons set
forth in New Matter, the averments of which are incorporated by reference herein.

deemed necessary, strict proof of the value of Plaintiff's labor and materials is demanded at time
of trial.
25. Denied. Paragraph 25 of Plaintiff's Complaint contains a, series of unwarranted
conclusions of law to which no response is required by Defendants.
26. Denied. Paragraph 26 of Plaintiff's Complaint contains a series of unwarranted
conclusions of law to which no response is required by Defendants. For reasons set forth in New
Matter, Defendants have enjoyed no benefits from the services alleged to have been provided by
Plaintiff.
WHEREFORE, Defendants request this Court to enter judgment in their favor and
dismiss the claims in Court II of Plaintiffs Complaint with prejudice.

27. Plaintiffs Complaint should be barred by the applicable statute(s) of limitation.
28. Plaintiff's Complaint fails to set forth any claim or cause of action against any one or
more Defendants for which relief may be granted.
29. Plaintiff identifies itself as doing business as "ServiceMaster of Greater Harrisburg
and West Shore".
30. Plaintiff has not registered and filed a fictitious name for "ServiceMaster of Greater
Harrisburg and West Shore" with the Pennsylvania Department of State.
31. Plaintiff is not permitted to maintain this or any other action or proceeding in this
Court by its failure to file the fictitious name "ServiceMaster of Greater Harrisburg and West
Shore" in Pennsylvania.
32. For the reasons set forth above, Plaintiff has no standing in this action.
33. Representatives of Plaintiff used the microwave in Defendants' kitchen and ate in the
home during the time that Plaintiff was to have been providing services to Defendant Cynthia
Barba.
34. Plaintiff claims to have cleaned the duct work in the residence; however, there were
pieces of finished trim found in the duct work after Plaintiff supposedly cleaned the ducts.
35. Plaintiff did not properly re -tape the duct work after supposedly cleaning it.
36. Defendant Cynthia Barba was advised that Plaintiff would not clean inside the walk-
in closet.
37. Plaintiff entered into the walk-in closet and cleaned only the rod used for hanging
clothes and a shelf located above the rod.

38. With respect to the master bathroom, Plaintiff cleaned only one sink and cleaned
nothing else in the master bathroom.
39. Plaintiff left soot around numerous receptacles throughout the home.
40. Plaintiff folded and ripped posters and damaged furniture.
41. Plaintiff did not properly clean items leaving numerous items with soot and dirt on
them.
42. Plaintiff was to wipe down all items in the kitchen, but left items that were obviously
not cleaned or wiped down.
43. Plaintiff left stains on certain recessed light fixtures and failed to property clean
them.
44. Plaintiff failed to clean areas of the carpet.
45. Plaintiff improperly packed numerous items.
46. Plaintiff falsely claimed that it was illegal for Plaintiff to unpack items that Plaintiff
had packed.
47. A representative of Plaintiff told Defendant Cynthia Barba that he would only deal
with her and not with her husband, Defendant Frank Barba.
48. Plaintiff threw used rags on the furniture in Defendants' home and left grease on
Defendants' white carpet.
49. Plaintiff failed to complete the cleaning of the residence and the items in the
residence and improperly and not thoroughly cleaned items in the residence.
50. Defendant Cynthia Barba never insisted that the carpet be replaced.
51. Defendant Cynthia Barba made payment of $1,077 to Plaintiff.

52. In addition to damaging furniture, Plaintiff damaged items when they were removed
from walls for packing.
53. Plaintiff attempted to invoice Defendant Cynthia Barba for items that were not
cleaned and work that was not done.
54. Plaintiff charged Defendant Cynthia Barba for cleaning a hallway door that never
existed in the residence.
WHEREFORE, Defendants request that Plaintiff's Complaint be dismissed with
prejudice and judgment be entered in their favor.

specifically denied. To the contrary, ServiceMaster employees ate during breaks and lunch times
designated by ServiceMaster.
34. Denied. ServiceMaster encountered no pieces of finished trim while cleaning the
ducts. By way of further response, ServiceMaster was engaged to remove soot from the ducts

and did so using equipment specialized for the removal of the same and similar debris. To the
extent that defendants claim to have found finished trim in the ducts, ServiceMaster is without
knowledge or information sufficient to form a belief as to the truth or falsity of these allegations
and they are therefore denied.
35. Denied. It is denied that ServiceMaster properly re -taped the duct work after
cleaning it. To the contrary, the re -taping was performed by a prior contractor who was removed
from the job by the Barbas.

contrary, it was defendant Cynthia Barba who specifically directed and ordered ServiceMaster
not to clean inside the walk-in closet after ServiceMaster had commenced cleaning said closet.

response, ServiceMaster did not complete the cleaning of the walk-in closet because defendant
Cynthia Barba specifically directed ServiceMaster's employees not to do so.

contrary, ServiceMaster removed all of the soot from the master bathroom per the Agreement
and estimate described in the Complaint. By way of further response, the Barba family was
using the house while the work was being performed, and created additional dirt and debris in
the house which ServiceMaster was not responsible to remove. Indeed, Cynthia Barba
demanded that ServiceMaster clean rooms which had been previously cleaned after the Barba
family had used the rooms and created additional dirt and debris.

removed the soot around the receptacles in the house.

further response, the posters and furniture referenced in this paragraph are unnamed and
unidentified, and, therefore, ServiceMaster cannot know with specificity about which items this
paragraph refers. However, after reasonable investigation, ServiceMaster is unaware of any
damage to posters or furniture, and defendants did not bring any such damage to the attention of
ServiceMaster employees while the work was being performed or at any time prior to
ServiceMaster demanding payment for the work.

employees were still working. Therefore, any items which remained unclean were the result of
subsequent use by defendants and defendants' family.

further response, defendants home had numerous stains and significant dirt and defects which
were not caused by the soot and were not part of the Agreement between the parties. The light
fixtures referenced in this paragraph are unnamed and unidentified, and, therefore, ServiceMaster
cannot know with specificity about which light fixtures this paragraph refers. However, after
reasonable investigation, ServiceMaster is unaware of any light fixtures which were included in
the Agreement which were not cleaned, and defendants did not bring any such un -cleaned
fixtures to the attention of ServiceMaster employees while the work was being performed or at
any time prior to ServiceMaster demanding payment for the work.

"threw used rags on the furniture" or "left grease on Defendants' white carpet." Defendant
Cynthia Barba advised ServiceMaster that there was a single dirty rag on the carpet, which
ServiceMaster promptly removed and cleaned the carpet underneath.

from an account of defendants, but rather was drawn on an account bearing the name "Keystone
Enterprise, LLC."

further response, the items and furniture referenced in this paragraph are unnamed and
unidentified, and, therefore, ServiceMaster cannot know with specificity about which furniture

damaged items or furniture to the attention of ServiceMaster employees while the work was
