`r_ °AND NON,this 27th day of June, 2014, upon consideration of the Petition for Grant
of Letters filed by Jennifer G. Penwell and David J. Garell, for the above decedent, it is
noted that the instrument offered for probate and purporting to be the Last Will and
Testament of Louise Ann Garell Shuey dated August 15, 2013, and consisting of 6
unbound pages (hereinafter referred to as the Decedent's Will) containing the following
peculiarities:
(1) It appears that a layman prepared the Decedent's Wilt.
(2) It appears that the Decedent's Will was drafted on a computer and possibly
with the assistance of some premade format or software program.
(3) There are two sets of type printed numbers appearing on the bottom of each
page of Decedent's Will, listed in order:
Set 1: 1 of 6, 2 of 6, 3 of 6, 4 of 6, 5 of 6 and 6 of 6.
Set 2: 1 of 3, 2 of 3, 3 of 3, 4 of 3, 5 of 3 and 6 of 3.
(4) The final page, page 6, includes lines for a signature and date. Those lines
have been lined through.
(5) The Decedent's Will appears to encompass pages 1 through 3 beginning
with the heading "Last Will and Testament".
(6) Decedent's signature appears on page 1 and twice on page 3, it appears
that one of those signatures was to be on the bottom of page 2 but carried
over to page 3.
(7) The Decedent's Will ends on page 3 with Decedent's signature.
(8) Page 4 also begins with the heading "Last Will and Testament" but it appears
to be a witness statement.
(9) Page 5 begins with Decedent's signature that appears as though it should
have been on the bottom of page 4 but carried over to page 5.
(10) Page 5 is an acknowledgement by a notary public.
(11) There are additional oddities that go to the content of the Will and are a
matter to be dealt with during the administration of the estate. They are
acknowledged as existing, but will not be addressed herein.
Although the above items are concerning, they are not considered to be fatal
flaws; therefore, IT IS DECREED the six pages of the Decedent's Will are admitted to
probate as The Last Will and Testament of Louise Ann Garell Shuey, Letters
Testamentary are hereby issued to Jennifer G. Penwell and David J. Garell. They shall
have all the rights and duties of fiduciaries under the laws of Pennsylvania and shall
proceed with the administration of this estate according to law.
