WHEREAS, KABGROUP, INC. dba KEITH A, BAREFOOT CUSTOM HOMES of 144 Millers
Gap Road, Enola, Pennsylvania, is about to execute contemporaneously herewith, a contract, with KAB
GROUP, INC. dba KEITH A, BAREFOOT CUSTOM HOMES of 144 Millers Gap Road, Enola,
Pennsylvania, Pennsylvania, for the erection of a building upon premises commonly known as LOT 58
LOOKOUT DRIVE, Township Hampden, Cumberland County, Pennsylvania, as set forth in the deed
datedS,O.fCJ"1b, 9, d.CD';)fecorded at Deed Book , Page , in the Recorder's Office
for Cum~erland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated
herein and attached hereto.
NOW, April!, 2005, at the time of and immediately before the execution of the principal contract,
and before any authority has been given by the said Owner to the said Contractor to commence work on
the said building, or purchase materials for the same in consideration of the making of the said contract
with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is
agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any
of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THA T CERTAIN tract or parcel of land being situate in Township of Hampden,
County of Cumberland, and Commonwealth of Pennsylvania, more particularly bounded and
described as follows, to wit:
BEGINNING at a point located on the southerly right of way line of Lookout Drive,
said point being a front property corner of Lot 57; thence along Lot 57, South 2 degrees 3
minutes 18 seconds East, a distance of 214.63 feet to a point on the northerly right of way line
of Smith Drive; thence along said northerly right of way, North 73 degrees 10 minutes 40
seconds East, a distance of 191.22 feet to a point; thence along Lot 59, North 16 degrees 49
minutes 20 seconds West, a distance of 220,59 feet to a point on said southerly right of way;
thence along said right of way, by a curve to the right having a radius of 790.00 feet an arc
distance of 61.74 feet being subtended by a chord of South 77 degrees 44 minutes 16 seconds
West, a distance of 61. 72 feet to a point; thence along the same, South 79 degrees 58 minutes
36 seconds West, a distance of 36.62 feet to a point; thence along the same, by a curve to the
left having a radius of 20,00 feet an arc distance of 19.47 feet being subtended by a chord of
South 52 degrees 5 minutes 28 seconds West, a distance of 18,71 feet to a point; thence along
the same, by a curve to the right having a radius of 60 feet an arc distance of 26.49 feet being
subtended by a chord of South 36 degrees 51 minutes 6 seconds West, a distance of 26.27 feet
to a point, said point being the POINT OF BEGINNING,
BEING all of Lot 58, Phase IV, Signal Hill Residential Development, as shown on a
plan titled "Signal Hill, Tract 1, Final-Phase 4", as prepared by Melham Associates, PC,
dated July 25, 2003 in Plan Book 87, page 136.
