STIPULATION AGAINST LIENS
THIS AGREEMENT made this ~ day of fifllL
between FARINELLI CONSTRUCTION, INC., hereinafter
Contractor,
2005, by and
referred to as
AND
James V. Wade and Denise E. Wade, husband and wife, hereinafter
referred to as Owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Upper Allen Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #21 Fair Oaks,
Phase I, Mechanicsburg, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL that certain tract or parcel of land situate in Upper Allen Township, Cumberland
County, Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the southern right of way line of Ravenwood Road, said point
also being a common property corner of Lot 20 and Lot 21 of the hereinafter referenced
Final Subdivision Plan; thence along the southern right of Ravenwood Road North 71
degrees 49 minutes 37 seconds East a distance of 120.00 feet to a point, said point being a
common property corner of said Lot 21 and Lot 22 of the hereinafter referenced Final
Subdivision Plan; thence along the western boundary line of said Lot 22 South 18 degrees
10 minutes 26 seconds East a distance of 139.98 feet to a point on the northern property line
of lands now or formerly of Robert C. and Beverly D. Stuart, said point being a common
property corner of said Lot 21 and said Lot 22; thence along the northern boundary line of
said Stuart lands and the northern boundary lines of lands now or formerly of Howard R.
and Laurie S. Greenawalt South 71 degrees 49 minutes 34 seconds West a distance of 120.00
feet to a point, said point being a common property corner of said Lot 21 and said Lot 20;
thence along the eastern houndary line of said Lot 20 North 18 degrees 10 minutes 26
seconds West a distance of 139.99 feet to a point, the Place ofBEGlNNING.
BEING Lot No. 21 depicted on the Phase I Final Suhdivision Plan for The Manor at Fair
Oaks, said plan dated April 22, 2002 last revised August 30, 2002, prepared by Alpha
Consulting Engineers, Inc., Project Number 210544, and recorded in the Office of the
Recorder of Deeds of Cumberland County in Plan Book 86, Page 1.
