COMPLAINT
AND NOW, comes Plaintiff, Pennsylvania National Mutual Casualty Insurance Company
by and through its attorneys, Goldberg Katzman, P.C., who states:
1. Plaintiff, Pennsylvania National Mutual Casualty Insurance Company (hereinafter
"Penn National") is a business entity with an address of 2 North Second Street, Harrisburg,
Dauphin County, Pennsylvania authorized to issue policies of insurance within the
Commonwealth Pennsylvania, including automobile insurance.
2. Defendant Melissa K. Boyer is an adult individual residing at 31 Prospect Road,
Carlisle, Cumberland County, Pennsylvania.
3. Defendant Alan Bouder, Jr. is an adult individual residing at 31 Prospect Road,
Carlisle, Cumberland County, Pennsylvania.
4. This matter arises from a motor vehicle accident that occurred on July 11, 2013 in
the parking lot of the Carlisle Giant located on South Spring Street, Carlisle, Pennsylvania.

5. On that date, Robert and Barbara Bush were the owners of a 2007 Infinity, FX35
that was legally parked within the parking lot.
6. On the aforesaid date, Defendant Alan Bouder, Jr. was the owner of a Dodge Ram
pick up truck.
7. On the aforesaid date, Defendant Melissa K. Boyer was operating the Bouder
Dodge pick up truck in the parking lot of Giant and struck the parked vehicle owned by Mr. and
Mrs. Bush causing damages thereto in the amount of $2952.17, including $34.15 for rental
expense.
8. Notice of this claim has been provided to the Defendants who have not paid for the
damages. As no payment was made, the Bush family submitted the claim to Plaintiff Penn
National which has paid the claim and pursues this action in subrogation against the responsible
persons.
COUNT I
Plaintiff v. Melissa K. Boyer
9. The averments to paragraphs 1 through 8 are incorporated herein by reference.
10. The aforesaid accident arose from the negligence, carelessness and recklessness of
Defendant Melissa Boyer in that she:
a. Failed to keep the truck under proper and adequate control;
b. Operated the vehicle at a speed excessive to the circumstances;
c. Permitted the vehicle to strike the parked vehicle owned by Mr. and Mrs.
Bush;
d. Fled the scene of the accident; and
e. Violated the rules and regulations for the operation of motor vehicle in the
Commonwealth of Pennsylvania.

11. As a direct result of the negligence, carelessness and recklessness of Defendant
Melissa K. Boyer, the damages as set forth above were caused.
WHEREFORE, Plaintiff demands judgment against Melissa K. Boyer, jointly and
severally, in the amount of$2952.17 with costs of suit.
COUNT II
Plaintiff v. Alan Bouder,Jr.
12. The averments to paragraphs 1 through 11 are incorporated herein by reference.
13. Defendant Alan Bouder, Jr. was the owner of the Dodge pick up truck operated by
Defendant Boyer at the time of the accident.
14. Defendant Boyer acted as the agent, servant or employee of Defendant Bouder at
the time of the accident and,therefore, Bouder is responsible for her actions.
15. In the alternative, Defendant Bouder entrusted a motor vehicle to Melissa K. Boyer
who he knew or should have known was not capable of or qualified to operate a motor vehicle
within the Commonwealth of Pennsylvania.
16. As a result of this negligent entrustment, the aforesaid accident and damages were
caused.
WHEREFORE, Plaintiff demands judgment against Defendant Alan Bouder, Jr., jointly
and severally, in the amount of$2952.17 together with costs of suit.
