prehearing conference was held in the jury deliberation roor�^of
Courtroom Number 6 of the Cumberland County Courthouse . Present
on behalf of Petitioner was Kathleen Misturak-Gingrich, Esquire.
Present on behalf of Respondent was Marc Roberts, Esquire . This
estate action is between Jan Stogsdill, the natural daughter, and
Jennifer Margush, niece, of E. Jeanne (Hogue) Recht, Decedent,
whose estate is valued at approximately $40, 000 . Petitioner is
seeking to invalidate the probated will while Respondent seeks to
continue forward under the terms and conditions of the will .
Petitioner shall proceed first with testimony, followed by
Respondent, then their respective witnesses . The time allotted
for this hearing is one full day (6 hours) .
The hearing shall commence on the 2nd of October,
2014 , at 9 : 00 a.m. , in Courtroom Number 6 of the Cumberland
County Courthouse .
There are no outstanding motions, and counsel are
requested to communicate prior to the hearing time to develop any
admissions or stipulations that they can reasonably agree upon to
expedite the proceeding.
The Court notes in its discussion with counsel
that the size of the estate and the necessity of this action may
be more practically resolved in another venue, if the parties can
agree to that . The parties are encouraged to speak with their �
. ,
respective attorneys about the viability of an alternative
dispute resolution forum in which to resolve their differences.
The Court notes there are many outside the
traditional legal courtroom environment "box" that can serve the
parties ' need for discourse and have a practical net savings to
the estate .
