THOMAS LEE THOMAS Defendant(s) CIVIL ACTION - LAW COMPLAINT The Plaintiff, MARINE FEDERAL CREDIT UNION, by its attorneys, KODAK LAW OFFICES, P.C., brings this action of Assumpsit against the Defendant(s) to recover the sum of FIVE THOUSAND TWO HUNDRED FIFTY TWO DOLLARS AND TWENTY ONE CENTS ($5,252.21), along with interest thereon at the rate of 14.5% from February 1, 2014, upon a cause of action of which the following is a statement: 1. The Plaintiff, MARINE FEDERAL CREDIT UNION, is a corporation organized and existing under the laws of the State of North Carolina, having an address of 4180 Western Blvd, Jacksonville NC 28540. 2. The Defendant, THOMAS LEE THOMAS, is an adult individual residing at 1361 ZIMMERMAN ROAD, CARLISLE, CUMBERLAND COUNTY, PENNSYLVANIA 17013. 3. Defendant submitted a Member Application to Plaintiff, a true and correct copy of said Member Application is attached hereto, marked Exhibit"A" and made a part hereof. 4. On or about May 31, 2006, the Defendant(s) entered into a Retail Installment Sale Contract,which contract was immediately assigned to Marine Federal Credit Union, 2 as well as a Guaranteed Asset Protection Contract, for the purchase of a new 2006 Dodge Charger. True and correct copies of the Retail Installment Sale Contract and Guaranteed Asset Protection Contract are attached hereto, collectively marked Exhibit "B" and made a part hereof. 5. The Defendant(s) defaulted on the obligation to make payments by neglecting and refusing to honor the remaining contract payments. 6. The balance due and owing in the amount of Four Thousand Three Hundred Seventy Six Dollars and Eighty Four Cents ($4,376.84) as set forth Plaintiff's Statement of Account attached hereto, marked Exhibit "C" and made a part hereof. 7. Due to the default of Defendant(s), and pursuant to the terms and conditions of the Retail Installment Sale Contract executed by Defendant(s), attorney's fees in the total amount of Eight Hundred Seventy Five Dollars and Thirty Seven Cents ($875.37) have been added to said account. 8.
