CIVIL DIVISION CUMBERLAND COUNTY BOARD OF ASSESSMENT APPEALS, Appellee PETITION FOR APPEAL 1. Appellant, Meadows At Bumble Bee Hollow, LP, is a Pennsylvania limited partnership with an address of 225 North Presidential Boulevard, Bala Cynwd, Montgomery County, Pennsylvania. 2. The Appellee, Board of Assessment Appeals of Cumberland County, Pennsylvania, is authorized to assess and value real property for the purpose of taxation and to hear appeals from said assessments by aggrieved parties. The Appellant is the record owner of 14 townhouse units situate in Upper Allen Township, Cumberland County, Pennsylvania, which townhouse units have the following Parcel Numbers 42-11-0276-191-U74 42-11-0276-191-U75 42-11-0276-191-U76 42-11-0276-191-U77 42-11-0276-191-U78 42-11-0276-191-U79 42-11-0276-191-U88 42-11-0276-191-U89 42-11-0276-191-U90 42-11-0276-191-U91 42-11-0276-191-U92 42-11-0276-191-U93 42-11-0276-191-U94 42-11-0276-191-U95 4. On March 6, 2014, after the Appellant completed construction of new townhouse units on the aforesaid parcels, the Appellee issued a change of assessment notice assessing the fair market values of the aforesaid parcels at assessments ranging from $185,800 to $191,500. 5. The Appellant filed a timely appeal from the aforesaid assessments. 6. A hearing on the aforesaid appeals was held before the Board of Assessment Appeals on June 19, 2014 at which time a decision was deferred pending the provision of additional information to the Board of Assessment Appeals by the Appellant. 7. On June 24, 2014, in contradiction of the deferment agreement reached at the hearing, the Appellee mailed Decision Notices to the Appellant denying the Appellant's appeal. True and correct copies of the Decisions are attached hereto as Exhibits A-1 through A-14. 8. The assessment of the 14 townhouse units as determined by the Board are contrary to law in that the fair market value upon which the assessments are based is in excess of the actual fair market value of the properties which fair market value for each parcel is $171,900. 9. The assessments are arbitrary, capricious, improper, unjust and unfair. WHEREFORE, Meadows at Bumble Bee Hollow, LP, being aggrieved by the assessments of the Board, files this appeal and requests Your Honorable Court to reverse the Decision of the Board and reduce the assessments of each townhouse unit to $171,900 and thereafter make all necessary orders and decrees to effectuate said Decision.
