NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within
claim for charges assessed with respect to sewer and /or refuse rates
against above named owner or owners and against the hereinafter
described real estate as follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendants) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seq., 53P.S. §7143, as amended. 40J.5o pmATTV

6. A description of the property against which this claim is filed is:
1115 Charles Street
Borough of Mechanicsburg
Cumberland County
Pennsylvania 17055
TAX PARCEL NUMBER 18-22-0519-058
7. This claim.has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim, is filed is
eight hundred and thirty dollars and ten cents ($830.10), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is April 1, 2013 to
June 30, 2014 on Sewer and Refuse Account 6132-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in
its favor and against the Defendants in the amount of eight hundred and
thirty dollars and ten cents ($830.10), plus cost and reasonable
attorney's fees.

WHEREAS,Josephine E. Gilleland became seized, in fee, of a certain parcel of land
situate in the Borough of Mechanicsburg, Cumberland County,Pennsylvania,more
particularly described herein(the"Premises"); and
WHEREAS,Josephine E. Gilleland(the"Decedent")died on April 28, 2007,possessed
of the Premises; and
WHEREAS, the said Josephine E. Gilleland died on April 28, 2007. Letters
Testamentary were granted to Ira G. Gilleland, III, on May 4, 2007, filed to Estate
Proceedings No. 2007-00432 in the Office of the Register of Wills, Cumberland County,
Pennsylvania, Grantor herein. Ira G. Gilleland, III, Executor of the Estate of the Estate of
Josephine E. Gilleland, being the Grantor herein; and
WHEREAS, 20 Pa.C.S. § 3351 provides"...the personal representative may sell, at
public or private sale, ...any real property not specifically devised..."; and
WHEREAS,the Executor, as Grantor, desires to convey the Premises to the Grantees.
WITNESSETH,that in consideration of ONE HUNDRED SEVENTY THOUSAND
DOLLARS ($170,000.00), in hand paid,the receipt whereof is hereby acknowledged,
the said Grantor does hereby grant and convey to the said Grantees, their heirs or assigns,
ALL THAT CERTAIN lot in Plan No. 1 of Orchard Crest, in the Borough of
Mechanicsburg, Cumberland County,Pennsylvania, as shown on the survey dated
August 10, 1961,by W. G. Rechel, R. E.,more fully described as follows,to wit:

where the division line between lots seven(7) and eight(8) intersects with the northerly
side of Charles Street; thence north twenty-two (22) degrees forty-seven (47)minutes
west, along the division line between lots seven(7) and eight(8), a distance of one
hundred forty-one and thirty-eight hundredths (141.38) feet to a point; thence north sixty-
six (66) degrees, forty-three(43)minutes east, a distance of seventy-five (75) feet to a
point; thence south twenty-two (22) degrees forty-seven(47)minutes east, along the
division line between lots eight(8) and nine(9), a distance of one hundred forty-one and
thirty-eight hundredths (141.38) feet to a point; thence south sixty-six (66)degrees forty-
three(43)minutes west, along the northerly side of Charles Street, a distance of seventy-
five(75) feet to a point,the place of BEGINNING.
BEING THE SAME PREMISES which Campbell Luxury Living Homes, Inc.,
formerly M. R. Campbell, Inc., a Pennsylvania Corporation, having its principal place of
business at Dornsife, County of Northumberland and Commonwealth of Pennsylvania,
granted and conveyed to Ira Glenn Gilleland, Jr., and Josephine E. Gilleland,husband
and wife, as tenants by the entireties, of Mechanicsburg, County of Cumberland and
Commonwealth of Pennsylvania,by deed dated August 7, 1962, recorded in the
Recorder's Office of Cumberland County, Pennsylvania, in Deed Book P,Volume 20,
Page 614. Ira Glenn Gilleland, Jr., died on September 28, 2006, vesting sole title in
Josephine E. Gilleland,deceased.
TOGETHER with all and singular the buildings,ways,waters, water-course,rights,
liberties,privileges,hereditaments and appurtenances whatsoever thereunto belonging, or
in anywise appertaining, and the reversions and remainders, rents, issues and profits
thereof; and all the estate, right,title,interest,property, claim and demand whatsoever, of
Grantor, in law, equity,or otherwise howsoever, of, in and to the same and every part
thereof.
TO HAVE AND TO HOLD the said buildings, hereditaments and premises hereby
granted or mentioned and intended so to be,with the appurtenances, unto the Grantees,
their heirs and assigns,to and for the only proper use and behoof of the Grantees, their
heirs and assigns forever.
AND the said Grantor does by these presents, covenant, grant and agree, to and with the
said Grantees, their heirs and assigns that the said Grantor, all and singular the
hereditaments and premises hereinabove described and granted or mentioned, and
intended so to be, with appurtenances, unto the said Grantees, their heirs and assigns,
against the said Grantor and against all and every other person or persons whomever,
lawfully claiming or to claim the same or any part thereof,that they shall and will,by
these presents,WARRANT AND FOREVER DEFEND.
UNDER AND SUBJECT to covenants, conditions, reservations,restrictions, easements,
and right of ways of record.
