Whalen, by and through the undersigned attorneys, Johnson, Duffie, Stewart & Weidner, and files the following Complaint against Defendants, Jay Murray and Tammy Ann Murray, and in support thereof avers as follows: 1. The Plaintiff, Pamela J. Whalen is an adult individual residing at 623 Whitetail Drive, Lewisberry, York County, Pennsylvania 17339. 2. At all time relevant hereto, Plaintiff, a sole proprietor, was trading and doing business as Designs by Pamela with a business address of 623 Whitetail Drive, Lewisberry, PA 17339. 3. Defendants, Jay Murray and Tammy Ann Murray, are adult individuals who reside at 405 Cherokee Drive, Mechanicsburg, PA 17055. 4. On or about January 17, 2013, Plaintiff, trading and doing business as Designs by Pamela, entered into a contractual agreement with Defendants pertaining to home improvements to be done to Defendants' residence located at 405 Cherokee Drive, Mechanicsburg, PA 17055. 5. The initial scope of the work involved was provided by Plaintiff and outlined, estimated and initialed by the Defendants on sales orders which are attached hereto and incorporated herein as Exhibit A. 6. Proposals giving further details to the scope and cost of the work as prepared by Plaintiff and provided to Defendants are attached hereto and incorporated herein as Exhibit B. 7. The project involved the following scope of work: a. Kitchen. The contract involved removing the existing kitchen cabinets and closet as well as opening soffits in both walls on each side of the dining room. It further included electrical work and closing in the wall to the music room. The original agreement between the parties also included the cost for labor to install the cabinets as well as two columns in the kitchen. These items were agreed upon and accepted in writing for an estimated amount of Eight Thousand Seven Hundred Twelve ($8,712.00) Dollars. b. Sunroom. The project involved adding a 12 foot by 12 foot sunroom for which the Plaintiff provided an initial estimate for a scope of work to include everything but lights/fans, doors, windows or floor covering. That estimate and proposal was agreed upon and initialed by Defendants in the amount of Fifteen Thousand Eight Hundred Forty ($15,840.00) Dollars. c. Flooring. An initial proposal for flooring was presented to the Defendants and initialed as approved. That scope of work included labor for the removal of existing floors (excluding the music room), wood and ceramic tiles in the kitchen, dining room, living room and foyer. It also included labor to reinstall wood flooring throughout the first floor. The cost of the flooring material itself was excluded for a total price of Six Thousand Three Hundred Ninety ($6,390.00) Dollars. 2 d. Deck. The Defendants were provided a sales order estimate for work to be done pertaining to the removal and reinstallation of a new deck by Plaintiff and initialed by Defendants. The scope of the work, as clearly set forth in that sales order, included the construction of a 12 foot by 15 foot deck with 4 foot stairs to lower area with existing brick pavers to be reset. New framing, supports and joists can be installed as needed. Excavation around the deck and landscaping block for retaining walls were to be installed. Final railings and spindles were to be installed as needed using Veranda decking boards or similar in cast. The contract as it pertains to the deck provided certain allowances for material and labor which totaled Ten Thousand Eight Hundred ($10,800.00) Dollars. e. Electrical. By written sales order approved and initialed by the Defendants, the Plaintiff agreed to provide certain electrical services including lighting involving the installation of eight (8) canister lights and pendant lights over kitchen peninsula, the installation of a new breaker and main panel in place of existing panel for an estimated price of Two Thousand One Hundred Forty -Two ($2,142.00) Dollars. f. Permits. By sales order presented and agreed upon by signature of Defendants, the Defendants agreed to pay for all permits applied for by Rutters Construction, the contractor responsible for the structural and carpentry work on the project. g. Windows/Doors. Plaintiff presented Defendants with a sales order which was initialed by Defendants to install replacement windows in existing window openings for One Thousand Five Hundred ($1,500.00) Dollars. The agreement further provided that Plaintiff would remove the family room door in the alcove area and install new construction windows and all masonry framing and supports and trim work on interior and exterior drywall as needed. The estimated cost as agreed by the parties was One Thousand Four Hundred Forty ($1,440.00) Dollars. Any rerouting or rewiring associated with said installation was estimated to be Two Hundred Forty ($240.00) Dollars. In addition, the agreed upon estimate included the family room door which was torn out and replaced with a new nine (9) foot door to include all necessary framing and support as well as rerouting electrical and/or exterior lights, the installation of trim work in the interior and trim on the exterior. The agreed upon estimated costs was Two Thousand Six Hundred Forty ($2,640.00) Dollars. This also included removing the window in the eat -in area and install a door to include labor and framing. This agreed upon estimate was Nine Hundred Sixty ($960.00) Dollars. 8. Initially, in January of 2013, the estimated cost of the project as it relates to labor and materials provided by Plaintiff totaled Fifty Thousand Six Hundred Sixty -Four ($50,664.00) Dollars. This excluded the kitchen materials, appliances, flooring throughout as well as interior design services. 9. The services and materials provided by Plaintiff continually changed over the ensuing months and the costs of those services and the breakdown and itemization of those services is outlined in Exhibit B. That itemization and estimate was provided to the Defendants and totaled Forty -Six Thousand Five Hundred Twelve ($46,512.00) Dollars. 10. After further changes orders, the final cost of services and materials provided by Plaintiff to Defendant as well as all other costs associated with the project and payments made by Defendants are outlined in Exhibit C, which is attached hereto and incorporated herein. 11. In July of 2013, the Defendants paid $10,000.00 directly to Tim Rutter, the carpenter and paid Plaintiff Five Thousand ($5,000.00) Dollars. At that point, the Defendants had paid the balance for the home improvements down to Fifteen Thousand Three Hundred Thirty - Nine Dollars and Seventy -Seven Cents ($15,339.77). At that point, the Defendants terminated 4 the contract and relationship with Plaintiff. Plaintiffs then paid the balance of the construction costs to the other contractors directly. 12. In addition to the sales orders and estimates attached hereto as Exhibits A, B and C, the Plaintiff provided the Defendants a monthly invoice for services and materials for the home improvements so as to keep the Defendants apprised of the cost of the project. A true and correct copy of said invoices are attached hereto and incorporated herein as Exhibit D. 13. In addition to the home improvement project outlined on the sales orders attached as Exhibits A, B and C, the Plaintiff agreed to provide interior decorating services at the request of Defendants. The services provided at the request of Defendants are set forth in Exhibit E attached hereto and incorporated herein. Those interior decorating services and the cost associated with those services are contained in the invoices which includes both products and the hourly consultation design fees are set forth in Exhibit D. As set forth in Exhibit D, the total for those services and hourly consultation fees was Eight Thousand Seven Hundred Ninety -Six Dollars and Seventy -Two Cents ($8,796.72) (Invoice #12119) as well as an unpaid balance of One Thousand Three Hundred Ninety -Three Dollars and Three Cents ($1,393.03) (Invoice #12117). 14. The interior design services were a separate verbal agreement of the parties whereby the Defendants agreed to pay to the Plaintiff the invoiced cost of the goods and materials purchased as well as a $50.00 per hour consultation design fee. 15. At all times and in all aspects of the project, both home improvement and interior design, the Defendants reviewed and approved all labor and purchase orders before said orders were made by Plaintiff and paid for by Plaintiff. 16. At all times relevant hereto, the Defendants were aware of the costs associated with all labor, materials and products purchased for the entire project as the same were approved prior to acquisition. 5 1. 17. The invoice (#12117) set forth as Exhibit D for design services was delivered to the Defendants on or about June 26, 2013 and demand has been made of the Defendants to make payment on said invoice balance but no payment has been made to date. 18. The Defendants verbally indicated that they are refusing to pay any additional money for the design services. 19. Plaintiff had additional unbilled design services which are set forth in Exhibit D, invoice (#12119) dated August 8,2013 which was not delivered to Defendants until sometime after disputes arose. 20. All of the home improvement and interior design services set forth in said invoices, Exhibit D, have been provided to the Defendants who currently retain the same. COUNT I UNJUST ENRICHMENT 21. Plaintiff incorporates by reference the averments contained in Paragraphs 1 through 20 of the foregoing Complaint as if set forth at length. 22. The Defendants ordered and requested interior design services and materials to be provided as outlined in Exhibit D and Exhibit E and, despite repeated demand, have not paid the Plaintiff who provided those materials and services for the same. 23. The Defendants will be unjustly enriched if Plaintiff is not paid Ten Thousand One Hundred Eighty -Nine Dollars and Seventy -Five Cents ($10,189.75) for the materials and services provided. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of Ten Thousand One Hundred Eighty -Nine Dollars and Seventy -Five Cents ($10,189.75) requiring submission of this case to compulsory arbitration pursuant to the Local Rules of Court. 6 COUNT II BREACH OF CONTRACT 24.
