The petition of the undersigned respectfully represents that:
Your petitioner is 18 years of age or older and the Executrix named in the last will ofthe above
decedent, dated March 30, 2000, and codicil(s) dated [none].
Decedent was domiciled at death in Cumberland County, Pennsylvania, with his last family or
principal residence at 311 Mill Street, Mt. Holly Springs, South Middleton Township.
Decedent, then 90 years of age, died May 14, 2002, at Carlisle Regional Medical Center,
Carlisle, Pennsylvania.
Except as follows, decedent did not marry, was not divorced and did not have a child born or
adopted after execution of the will offered for probate; was not the victim of a killing and was never
adjudicated incompetent:

I, JOHN H. SHERMAN, a legal resident of South Middleton Township, Cumberland
County, Pennsylvania, being of sound and disposing mind, memory, and understanding, do
hereby make, publish, and declare this as and for my Last Will and Testament, hereby revoking
all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, including my grave
marker, shall be paid from the assets of my estate as soon as practicable after my decease.
SECOND: I direct that all taxes that may be assessed in consequence of my death, of
whatever nature and by whatever jurisdiction imposed, shall be paid from my residuary estate as
a part of the expense of the administration of my estate.
THIRD: I bequeath those articles of my household furnishings, personal effects,
and personal property as set forth in a separate memorandum, which I intend to sign and keep
with my copy of this Will, to the persons named in that memorandum.
FOURTH
I hereby give and devise the following specific bequests:
A. To my daughter, Joyce C. Wenner, the pink set of dishes;
B. To my daughter, Nancy 1. Line, the "fish" set of dishes, the electric roaster and
the antique slaw cutter;
C. To my daughter, June 1. Barge, the "Washington" set of dishes and the salt dishes
(for onion, celery, etc.); and
D. To my son, Robert 1. Sherman, the child's plank bottom rocker.
FIFTH: I give, devise and bequeath all of the residue of my estate, of every nature
and wherever situate, to the following persons in the shares indicated:
A. One percent thereof to Dorothy Badorf, provided should she fail to survive me, I
devise said share equally to my hereinafter named children who shall have
survived me;
B. Two percent thereof to my daughter, Joyce C. Wenner, provided should she fail to

C. One-fifth ofthe balance to my son, Charles A. Sherman, provided should he fail
to survive me, said share shall be divided equally among Richard 1. Sherman,

D. One-fifth of the balance to my son, Richard 1. Sherman, provided should he fail
to survive me, said share shall be divided equally among Charles A. Sherman,
Nancy 1. Line, June 1. Barge and Robert 1. Sherman, or the survivors;
E. One-fifth of the balance to my daughter, Nancy 1. Line, provided should she fail
to survive me, said share shall be divided equally among Charles A. Sherman,
Richard 1. Sherman, June 1. Barge, and Robert 1. Sherman, or the survivors;
F. One-fifth ofthe balance to my daughter, June 1. Barge, provided should she fail
to survive me, said share shall be divided equally among Charles A. Sherman,
Richard 1. Sherman, Nancy 1. Line and Robert 1. Sherman, or the survivors; and
G. One-fifth of the balance to my son, Robert 1. Sherman, provided should he fail to
survive me, said share shall be divided equally among Charles A. Sherman,
Richard 1. Sherman, Nancy 1. Line and June 1. Barge, or the survivors.
It is my intention that the residue of my estate not be devised per stirpes, as my
grandchildren shall be precluded from inheriting any portion of my estate.
SIXTH: I nominate, constitute and appoint my daughter, Nancy 1. Line, Executrix,
of this, my Last Will and Testament. In the event of the renunciation, death, resignation, or
inability to act for any reason whatsoever of the said Nancy 1. Line, I nominate, constitute, and
appoint Charles A. Sherman, Executor, of this, my Last Will and Testament. I hereby relieve my
Executrix or her successor from the necessity of posting security in connection with their duties
as such in any jurisdiction in which they may be called upon to act, insofar as I am able by law so
to do.
IN WITNESS WHEREOF, I have hereunto set my hand and seal to this, my Last Will
and Testament, consisting of three typewritten pages, each of which bears my initials, this .3b~

PURPOSE OF THE APPRAISAL
The purpose of this appraisal is to estimate the Market Value of the subject propel1y as

Market Value, as defined by the courts, is the most probable price estimated in terms of
money which a pi(Jpe1ty will bring if exposed for sale in the open market, allowing a

The Cost Approach to value is based on the principle of substitution, which proposes

In estimating the cost of providing a substitute, the following functions are completed.

deterioration, functional obsolescence and external depreciation, if applicable, is deducted to

Valuation Service, adjusted to the local area and verified with local contractors.

I, JOHN H. SHERMAN, a legal resident of South Middleton Township, Cumberland
County, Pennsylvania, being of sound and disposing mind, memory, and understanding, do
hereby make, publish, and declare this as and for my Last Will and Testament, hereby revoking
all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, including my grave
marker, shall be paid from the assets of my estate as soon as practicable after my decease.
SECOND: I direct that all taxes that may be assessed in consequence of my death, of
whatever nature and by whatever jurisdiction imposed, shall be paid from my residuary estate as
a part of the expense of the administration of my estate.
THIRD: I bequeath those articles of my household furnishings, personal effects,
and personal property as set forth in a separate memorandum, which I intend to sign and keep
with my copy of this Will, to the persons named in that memorandum.
FOURTH
I hereby give and devise the following specific bequests:
A. To my daughter, Joyce C. Wenner, the pink set of dishes;
B. To my daughter, Nancy 1. Line, the "fish" set of dishes, the electric roaster and
the antique slaw cutter;
C. To my daughter, June 1. Barge, the "Washington" set of dishes and the salt dishes
(for onion, celery, etc.); and
D. To my son, Robert 1. Sherman, the child's plank bottom rocker.
FIFTH: I give, devise and bequeath all of the residue of my estate, of every nature
and wherever situate, to the following persons in the shares indicated:
A. One percent thereof to Dorothy Badorf, provided should she fail to survive me, I
devise said share equally to my hereinafter named children who shall have
survived me;
B. Two percent thereof to my daughter, Joyce C. Wenner, provided should she fail to

It is my intention that the residue of my estate not be devised per stirpes, as my
grandchildren shall be precluded from inheriting any portion of my estate.
SIXTH: I nominate, constitute and appoint my daughter, Nancy L. Line, Executrix,
of this, my Last Will and Testament. In the event of the renunciation, death, resignation, or
inability to act for any reason whatsoever of the said Nancy L. Line, I nominate, constitute, and
appoint Charles A. Sherman, Executor, of this, my Last Will and Testament. I hereby relieve my
Executrix or her successor from the necessity of posting security in connection with their duties
as such in any jurisdiction in which they may be called upon to act, insofar as I am able by law so
to do.

The Petition of Nancy 1. Line, pursuant to 20 P.S.C.A. 93356, respectfully represents as
follows:
I. John H. Sherman ("Decedent") died on May 14, 2002, leaving his Last Will and
Testament dated March 30, 2000, which was duly probated before the Register of Wills of Cumberland
County on May 22, 2002.
2. The Register of Wills granted Letters Testamentary to Petitioner.
3. At the time of death Decedent held fee simple title to real estate situate in South
Middleton Township, Cumberland County, Pennsylvania, known as 311 Mill Street, Mt. Holly Springs,
Pennsylvania, improved with a two-story dwelling and described in accordance with Exhibit "A"
attached hereto, and owned the contents located therein.
4. The real estate was appraised at a value of $69,000.00 by Larry E. Foote, Diversified
Appraisal Services, a copy of the appraisal is attached hereto as Exhibit "B".
5. The contents of said real estate were appraised at a collective value of$2,265.00, a copy
of the appraisal is attached as Exhibit "C".
6. Petitioner Nancy 1. Line desires to purchase the real estate for the sum of $69,000.00,
and the contents for the sum of$2,265.00.

(Estate No. 21 - 02 - 0507); and
WHEREAS, said Letters Testamentary remain in full force and effect; and
WHEREAS, said hereinafter described property was not specifically devised by said
Decedent; and
WHEREAS, said NANCY 1. LINE, Executrix petitioned the Orphans' Court of Cum berland
County pursuant to Section 3356 ofthe P A Probates, Estates and Fiduciaries Code for approval of
the purchase of real estate by the personal representative; and
WHEREAS, by order ofthe Orphans' Court of Cumberland County, dated October 28, 2002,
said sale was approved and the Clerk ofthe Orphans' Court was authorized and directed to execute
the within Deed.
NOW THIS INDENTURE WITNESSETH that the said DONNA M. OTTO, Acting First
Deputy Clerk of the Orphans' Court for and in consideration of the premises and pursuant to said
Order, and in further consideration of the receipt by the Estate of John H. Sherman of the sum of
Sixty-nine Thousand ($69,000.00) Dollars lawful money of the United States, paid by the said
Grantee at and before the sealing and delivery hereof, the receipt whereof is hereby acknowledged,
has granted, bargained, sold, aliened, released and confirmed, and by these presents does grant,
bargain, sell, alien, release and confirm unto the said Grantee, her heirs and assigns,

BEGINNING at a post on the public road leading to Mt. Holly Springs, near Carlisle
Junction R.R.; thence by said road, North seventy (70) degrees East, seven and four-
tenths (7.4) perches to a stone; thence along another public road, leading to Boiling
Springs, North six (6) degrees East, five (5) perches to a point; thence by lots now
or formerly ofU.B. Church and Mrs. Lawson, West seven (7) perches to a point;
thence by lot now or formerly of Peter Walters, South six (6) degrees West, seven
and four-tenths (7.4) perches to the place of BEGINNING. CONTAINING one-
fourth (1/4) acre.
BEING the same premises which Freida L. Sherman and John H. Sherman, her
husband, by deed dated February 20, 1965, and recorded in Cumberland County,
Pennsylvania, Deed Book "M", Volume 21, Page 650, granted and conveyed to
Freida L. Sherman and John H. Sherman, her husband. The said Freida L. Sherman
having died October 28, 1996, title vested entirely in the said John H. Sherman,
decedent herein.
TOGETHER with all and singular buildings, improvements, ways, waters, water-courses,
rights, liberties, privileges, hereditaments and appurtenances whatsoever, thereunto belonging or in
any wise appertaining, and the reversions and remainders, rents, issues and profits thereof; and also
all the estate, right, title, interest, use, trust, property, possession, claim and demand whatsoever of
the said John H. Sherman at and immediately before the time of his death, in law, equity or otherwise
howsoever, of, in, to or out of the same.
TO HAVE AND TO HOLD, the said buildings, improvements, hereditaments and premises
hereby granted and released, or mentioned and intended so to be, with the appurtenances, unto the
said Grantee, her heirs, and assigns, to and for the only proper use and behoof of the said Grantee,
her heirs or assigns, forever.
AND the said Grantor covenants, promises and agrees to and with the said Grantees, her heirs
and assigns, by these presents, that the said Grantor has not done, committed, or knowingly or

LAST WILL AND TESTAMENT
OF
JOHN H. SHERMAN
I, JOHN H. SHERMAN, a legal resident of South Middleton Township, Cumberland
County, Pennsylvania, being of sound and disposing mind, memory, and understanding, do
hereby make, publish, and declare this as and for my Last Will and Testament, hereby revoking
all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, including my grave
marker, shall be paid from the assets of my estate as soon as practicable after my decease.
SECOND: I direct that all taxes that may be assessed in consequence of my death, of
whatever nature and by whatever jurisdiction imposed, shall be paid from my residuary estate as
a part of the expense of the administration of my estate.
THIRD: I bequeath those articles of my household furnishings, personal effects,
and personal property as set forth in a separate memorandum, which I intend to sign and keep
with my copy of this Will, to the persons named in that memorandum.
FOURTH
I hereby give and devise the following specific bequests:
A. To my daughter, Joyce C. Wenner, the pink set of dishes;
B. To my daughter, Nancy L. Line, the "fish" set of dishes, the electric roaster and
the antique slaw cutter;
C. To my daughter, June L. Barge, the "Washington" set of dishes and the salt dishes
(for onion, celery, etc.); and
D. To my son, Robert L. Sherman, the child's plank bottom rocker.
FIFTH: I give, devise and bequeath all of the residue of my estate, of every nature
and wherever situate, to the following persons in the shares indicated:
A. One percent thereof to Dorothy Badorf, provided should she fail to survive me, I
devise said share equally to my hereinafter named children who shall have
survived me;
B. Two percent thereof to my daughter, Joyce C. Wenner, provided should she fail to

C. One-fifth of the balance to my son, Charles A. Sherman, provided should he fail
to survive me, said share shall be divided equally among Richard L. Sherman,
Nancy L. Line, June L. Barge and Robert L. Sherman, or the survivors;
D. One-fifth of the balance to my son, Richard L. Sherman, provided should he fail
to survive me, said share shall be divided equally among Charles A. Sherman,
Nancy L. Line, June L. Barge and Robert L. Sherman, or the survivors;
E. One-fifth of the balance to my daughter, Nancy L. Line, provided should she fail
to survive me, said share shall be divided equally among Charles A. Sherman,
Richard L. Sherman, June L. Barge, and Robert L. Sherman, or the survivors;
F. One-fifth of the balance to my daughter, June L. Barge, provided should she fail
to survive me, said share shall be divided equally among Charles A. Sherman,
Richard L. Sherman, Nancy L. Line and Robert L. Sherman, or the survivors; and
G. One-fifth of the balance to my son, Robert L. Sherman, provided should he fail to
survive me, said share shall be divided equally among Charles A. Sherman,
Richard L. Sherman, Nancy L. Line and June L. Barge, or the survivors.
It is my intention that the residue of my estate not be devised per stirpes, as my
grandchildren shall be precluded from inheriting any portion of my estate.
SIXTH: I nominate, constitute and appoint my daughter, Nancy L. Line, Executrix,
of this, my Last Will and Testament. In the event of the renunciation, death, resignation, or
inability to act for any reason whatsoever of the said Nancy L. Line, I nominate, constitute, and
appoint Charles A. Sherman, Executor, of this, my Last Will and Testament. I hereby relieve my
Executrix or her successor from the necessity of posting security in connection with their duties
as such in any jurisdiction in which they may be called upon to act, insofar as I am able by law so
to do.
IN WITNESS WHEREOF, I have hereunto set my hand and seal to this, my Last Will
