C.S.A. §�3182 AND 3183 TO THE HONORABLE, THE JUDGES OF THE SAID COURT: AND NOW, comes Petitioner, Linda M. Johnson,by and through their attorneys, Butler Law Firm, and files this Response and in support thereof respectfully states that: Petitioner, Linda M. Johnson is fully aware of the inharmonious relationship between herself and Respondent,Marsha A. White. In order to move forward with the estate administration, Petitioner will do everything in her power to put aside her differences with Respondent. Although we feel as though the administration would be completed in a more efficient manner if Petitioner were named as sole Executrix,Petitioner is willing to work with Respondent as long as Responden�is willing to work with Petitioner. We have also attached writings of Bessie Johnson that were discovered with her effects. These writings indicate that Bessie Johnson was also leaning toward the naming of Petitioner as her sole Executrix. It appears as though Respondent would prefer to hire one law firm to represent both of them in their capacities as Co-Executors. Respondent and Petitioner have failed on both previous attempts to hire and retain one law firm to perform this role. It is our strong feeling that if Petitioner and Respondent continue to interview law firms to represent both of them in their capacities as Co-Executors, it will cause further delays in the estate administration. Given the history between the Petitioner and Respondent,we find it highly unlikely that they will be able to hire and retain one law firm to represent both of them in their capacities as Co-Executors. We propose the Respondent personally retain legal counsel so that RespondenYs counsel and Petitioner's counsel can work together in some agreed capacity to further the estate administration. In an effort to be fair,we further propose that the Estate of Bessie Johnson pay the first$5,000.40 in legal fees incurred by each party. If Respondent does not feel as though she can put aside her differences with Petitioner and complete the estate adrninistration with Petitioner, and this Court cloes not choose to make Petitioner the sole Executrix,we feel strongly that new Letters Testamentary should be granted to Petitioner and Leah K. Rider as Co-Executors. Petitioner would work with Leah K. Rider in an effective and efficient manner to complete the estate administration. Leah K. Rider is Respondent's daughter and would most likely be biased in her administration of the estate if she were made the sole Executrix. It would also be unfair if Respondent was able to effectively control the situation by merely saying she can't wark with Petitioner if the result would be her daughter being named the sole Executrix.
