Plaintiff is The Bank of New York Mellon f/k/a The Bank of New York,as Trustee for the Certificateholders of the CWABS,Inc.,Asset-Backed Certificates, Series 2005-11. 2. The Defendant is Steve Devins,who is a mortgagor and real owner ofthe mortgaged property hereinafter described,whose last-known address is 6306 Valleybrook Drive,Mechanicsburg,PA 17050. 3. The Defendant is Tiffany R.Devins,who is a mortgagor and real owner of the mortgaged property hereinafter described,whose last-known address is 6306 Valleybrook Drive,Mechanicsburg,PA 17050. 4. On August 25,2005,Steve Devins and Tiffany R.Devins,mortgagors,made,executed and delivered a mortgage upon the premises hereinafter described to Mortgage Electronic Registration Systems, Inc.,as nominee for America's Wholesale Lender which mortgage is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1920, Page 1235 (the "Mortgage"), such Mortgage being incorporated herein by reference pursuant to Rule 1019(g)Pa.R. C. P. 5. On August 25, 2005, Defendant, Steve Devins, also executed an Adjustable Rate Note secured by the aforementioned mortgage.Plaintiff,directly or through an agent, is in possession of the note and is the holder of the note with the right to enforce it;the note is either made payable to plaintiff or has been duly endorsed. 6. On September 9,2010,the Defendant,United States of America,acquired a lien against the premises hereinafter described in the sum of$19,693.00,subordinate to the mortgagee hereinafter referred to,by reason of Federal Tax Lien,Docket Number: 2010-05809,in favor of the United States of America against Steven W. Devins & Tiffany Devins, and which is recorded in the Office of Prothonotary of Cumberland County,Pennsylvania. 8. Notice of this lien was filed on September 9, 2010, at the Office of the Prothonotary of Cumberland County,by the United States Department ofthe Treasury,Internal Revenue Service,Harrisburg, Pennsylvania.A true and correct copy ofNotice of Federal Tax Lien is attached hereto and marked as Exhibit "A." 9. By the filing of this action, Plaintiff seeks a judicial sale of the premises hereinafter described. 10. The premises subject to said mortgage is described in the legal description attached as Exhibit "B" and is known as 6306 Valleybrook Drive,Mechanicsburg,Pennsylvania 17050. 11. The mortgage is in default because monthly payments of principal and interest upon said mortgage due January 1, 2010 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 12.
