FAMILY SETTLEMENT AGREEMENT
THIS AGREEMENT, made as of this _ day of 2014, by and
between Donald Fisher, Executor and Rae Jean Durschlag, Esther M. Fisher, and Arbutus L.
Ness, as Beneficiaries.
WHEREAS, Esther M. Sloan, late of Silver Springs 'Township, Cumberland County,
Pennsylvania, died on August 1.7, 2013, testate; and
WHEREAS, Letters Testamentary were issued on September 10, 2013, to Donald
Fisher, where they remain of record at File No. 21-13-964;
WHEREAS, a Pennsylvania Inheritance Tax Return was filed with the Register of
Wills Office, as Agent for the Commonwealth of Pennsylvania, on behalf of the Estate of Esther
M. Sloan, and
WHEREAS, the Pennsylvania inheritance tax due on said estate has been paid in full,
and clearance has been received; and
WHEREAS, all known and substantiated outstanding debts and obligations of the
Decedent have been paid in full; and
WHEREAS, the parties hereto are the only parties in interest in the Estate of Esther '
M. Sloan and desire that distribution of the balance of the assets of the Decedent be made
without the necessity of further proceedings by the Orphans' Court or a formal accounting.
NOW, THEREFORE, in consideration of the payment and distribution of their share of
the Estate the undersigned beneficiaries under the Estate of Esther M. Sloan, late of Silver

Springs Township, Cumberland County, Pennsylvania, deceased, do hereby acknowledge that
they have received of and from Donald Fisher, Executor of the Estate of Esther M. Sloan,
deceased, their share of the Estate. The same being in full satisfaction of their share of the
Estate of said Decedent.
The undersigned do hereby by these presents, remise, release, quit-claim and forever
discharge Donald Fisher, Executor, his heirs and assigns, of and from the payment of any other
or further sum in satisfaction and payment of their share of the Estate of the Decedent, and of
and from all actions, suits, claims, duties and demands whatsoever arising therefrom. The
undersigned further agree to indemnify Donald Fisher, Executor, and to hold him harmless
from any claims or demands presented against the Estate of the Decedent subsequent to the
execution of this Release, including, but not limited to, any federal, state or local income taxes,
transfer inheritance, estate or death taxes, together with any interest or penalties thereon and
together with any costs, expenses and counsel fees associated therewith, if any.
In consideration of the distribution of their share of the Estate to them, the undersigned
agree that they shall be firmly bound unto Donald Fisher, Executor of the Estate of Esther M.
Sloan and/or to CGA Law Firm, Attorneys for the Estate of Esther M. Sloan in their
proportionate share of the amount of any claims or demands presented against the Estate as
set forth above, up to but not exceeding the amount of their share of said Estate, which
agreement shall be deemed to be in the nature of a refunding agreement or bond.
