Frey III, is an adult individual residing at 3410 Spring Road, Carlisle, Cumberland County, Pennsylvania, 17013. 2. Plaintiff,Jane W. Frey,is an adult individual residing at 3410 Spring Road, Carlisle, Cumberland County, Pennsylvania, 17013. 3. Defendant, Brandon Long, ("Defendant") is an adult individual residing at 25 East Main Street, Plainfield, Cumberland County, Pennsylvania, 17081. 4. On or about November 25, 2013, Frank Frey was operating a 2007 Toyota Camry ("Toyota") traveling north bound on North College Street in Carlisle, Cumberland County, Pennsylvania. 5. On the same day, Jane Frey was seated in the front passenger seat of the Toyota. 6. At the same time,Defendant was operating a 2003 Chevy Sedan("Chevy")heading east bound on Lincoln Street in Carlisle, Cumberland County, Pennsylvania. 7. A stop sign is located on Lincoln Street at the intersection of Lincoln Street and North College Street. 8. Frey Frank and Jane Frey had the right-of-way since they did not have a stop sign at the intersection. r i y t 9. As Frank Frey approached the intersection ofNorth College Street and Lincoln Street, Defendant proceeded to cross North College Street. 10. At this time, Defendant pulled out directly into the path of Frank Frey and Jane Frey as they were traveling across the intersection and struck the driver's side door of the Toyota. 11. Defendant's Chevy came to rest against the Toyota's drivers side door, which prevented Frank Frey from being able to exit the Toyota. 12. The collision caused disabling damage to both vehicles and both vehicles had to be towed away from the scene.A copy of the towing invoice for the Toyota is attached hereto as Exhibit «A " 13. As a result of the collision,the Defendant was cited by the Carlisle Police Department for duties at stop signs for entering the intersection without clearance and for required financial responsibility, as his auto insurance expired November 9, 2013. 14. Frank Frey had the right-of-way as he was proceeding north on North College Street and the intersection which Defendant approached while traveling on Lincoln Street was controlled by a stop sign. 15. The collision was caused solely as the result of the negligence, recklessness, and carelessness of the Defendant in that he: a. failed to yield the right-of-way to Frank Frey's vehicle; b. failed to properly stop at the stop sign; C. failed to properly proceed from the stop sign without assuring that it was safe to do so; and, d. failed to properly brake his vehicle to avoid causing a collision with Frank Frey's vehicle. 16. As the direct and proximate result of the collision, Frank Frey and Jane Frey were forced to incur the cost of having the Toyota towed, stored and the damage appraised,amounting to a cost of$996.00. A copy of the fees associated with the appraisal, storage,towing and teardown of the vehicle is attached hereto as Exhibit"B." 18. As a result of the damage, Frank Frey and Jane Frey were forced to incur the cost of renting a replacement vehicle in the amount of$1,011.87. A copy of the rental invoice is attached hereto as Exhibit "C." 19. As a result of the damage, the Frey's Toyota was declared a total loss and was appraised at having a fair market value of$12,433.88 at the time of the collision. A copy of the Market-Driven Valuation is attached hereto as Exhibit "D." 20. Having been declared a total loss, the Frey's collected the salvage value for their vehicle, minus the 3`d party fees and debits associated with the transaction, and received an overall payment of$2,792.00 for salvage. A copy of the documents explaining this transaction are attached hereto as Exhibit "E." 21. With the fair market value of the vehicle evaluated at $12,433.88, minus the $2,792.00 recouped from salvage, and the addition of $1,011.87 in rental fees, the Frey's have suffered a loss of$10,653.75. Autosource uses vehicles comparable in year, make and model within the specified market area, expanding as necessary, to determine the loss vehicle's local market value. This valuation includes a representative sample of the vehicles used to calculate the typical starting price. The market search originated from Zip Code 17013, as determined by the vehicle owner's principally garaged area. Autosource located 30, 2007 Toyota Camry vehicles which were used to determine the typical vehicle price. Adjustments have been made to the comparable vehicles for value differences in vehicle description as indicated in the "Veh Adj" field. The sum of the 30 comparable vehicles is$390,668 for an average price of$13,022. The asking or actual sale price is displayed for each vehicle. If a vehicle has been sold, the sold price is displayed with an (S) indicator. The selling price may be substantially less than the asking price. In the case of this 2007 Toyota Camry, the difference between the asking price and selling price is generally 6%. This selling price adjustment has been applied to the typical price.
