ROY and KAREN ANN ROY, Plaintiffs, VS. No.: FORD MOTOR COMPANY, Defendant. COMPLAINT 1. Plaintiff, Stephen J. Roy is an adult individual citizen and legal resident of the Commonwealth of Pennsylvania, residing at 67 Meadowlark Trail, Fairfield PA 17320. 2. Plaintiff, Karen Ann Roy, is an adult individual citizen and a legal resident of the Commonwealth of Pennsylvania, residing at 59 Lori Circle Mechanicsburg PA 17050. 3. Defendant, Ford Motor Company, is a corporation qualified to do business and which regularly conducts business in the Commonwealth of Pennsylvania, with its address and principal place of business located at Consumer Affairs, 16800 Executive Plaza Drive, 3 NE-B, Dearborn, Michigan 48126-4207, and can be served at that address. 4. Plaintiffs purchased a new 2012 Ford Fiesta on June 16, 2012, manufactured and warranted by Defendant,with a Vehicle Identification Number of 3FADP4BJ7CM207664. 5. The vehicle was purchased in the Commonwealth of Virginia and is registered in the Commonwealth of Pennsylvania. 1 6. The purchase price of the vehicle, including registration charges, document fees, sales tax and finance charges totaled more than $19,621.16. A true and correct copy of the buyer's order is attached hereto as Exhibit 1. 7. In consideration for the purchase of the vehicle, Defendant issued to Plaintiffs several express written warranties, including a 3 year/36,000 mile bumper-to-bumper warranty and a 5 year/60,000 mile powertrain warranty. A true and correct copy of the 2012 Model Year Ford Warranty Guide is attached hereto as Exhibit 2. 8. The written express warranties were part of the basis of the bargain between Defendant and Plaintiffs. 9. As a result of ineffective warranty repair attempts made by Defendant through its authorized dealer(s), the vehicle is rendered substantially impaired in value and safety and, unable to be utilized for its intended purposes. 10. Plaintiffs presented the vehicle to Defendant's authorized warranty repair facility on October 23, 2013 at 16,431 miles on the odometer for a repair attempt under warranty for a noise in the transmission. A true and correct copy of a repair invoice dated October 23, 2013 is attached hereto as Exhibit 3. 11. Plaintiffs presented the vehicle to Defendant's authorized warranty repair facility on October 29, 2013 at 16,605 miles on the odometer for a repair attempt under warranty for the transmission. A true and correct copy of a repair invoice dated October 29, 2013 is attached hereto as Exhibit 4. 12. Plaintiffs presented the vehicle to Defendant's authorized warranty repair facility on November 18, 2013 at 17,096 miles for a noise at 35 miles per hour or under. A true and correct copy of the November 18, 2013 repair order is attached as Exhibit 5. 2 f n 13. Plaintiffs presented the vehicle to Defendant's authorized warranty repair facility on November 30, 2013 at 17,238 miles on the odometer for a noise when going and the right front axle shaft was replaced. A true and correct copy of the repair order dated November 30, 2013 is attached as Exhibit 6. 14. Additional repair attempts were made after November 30, 2013. True and correct copies of the repair orders after November 30, 2013 are attached as Exhibit 7. 15. The nonconformities have not been repaired and substantially impair the vehicle's use, safety and value. COUNT MAGNUSON-MOSS (FTC)WARRANTY IMPROVEMENT ACT 16. Plaintiffs hereby incorporate all facts and allegations set forth in this Complaint by reference as if fully set forth at length herein. 17. Plaintiffs are "Consumers" as defined by 15 U.S.C. §2301(3) of the Magnuson Moss Warranty Act. 18. Defendant is a"supplier", "warrantor", and a "service contractor" as defined by 15 U.S.C. § 2301 (4),(5) and (8). 19. Plaintiffs' vehicle is a"consumer product" as defined by 15 U.S.C. § 2301(1). 20. The Magnuson Moss Warranty Act at 15 U.S.C. § 2310 provides for the enforcement of state warranty laws, including laws regarding express and implied warranties. 21. By the terms of its written warranties, Defendant agreed to perform effective repairs to the vehicle at no charge for parts and/or labor. 22. The Magnuson-Moss Warranty Improvement Act at 15 U.S.C. § 2308 prevents the disclaimer of implied warranties if an express warranty is offered at the time of the sale. 3 23. Plaintiffs provided to Defendant a reasonable number of repair attempts to repair the defects and nonconformities with the vehicle pursuant to Defendant's express written warranties, but these repair attempts were ineffective. 24. The vehicle was delivered to Plaintiff in a condition that did not meet the standards of the implied warranty of merchantability at 13 Pa.C.S. § 2314. 25. As a direct and proximate result of Defendant's failure to comply with the express written warranties and the implied warranty of merchantability, Plaintiffs have suffered damages and are entitled to bring suit under the Magnuson Moss Warranty Act. 26. Plaintiffs aver that Defendant's warranty was not provided to Plaintiffs until after the vehicle was delivered, making any and all limitations, disclaimers and/or alternative dispute provisions ineffective for a failure of consideration. 27. Defendant did not require Plaintiffs to first resort to a Dispute Resolution Program before filing suit. 28. Plaintiffs are entitled to the recovery of damages and attorneys' fees and costs against Defendant. WHEREFORE, Plaintiffs respectfully demand judgment against Defendant in an amount equal to the price of the subject vehicle, plus all collateral charges, incidental and consequential damages in an amount not in excess of $50,000 plus reasonable attorneys' fees, and all court costs. COUNT II PENNSYLVANIA UNFAIR TRADE PRACTICES AND CONSUMER PROTECTION LAW 29. Plaintiffs hereby incorporate all facts and allegations set forth in this Complaint by reference as if fully set forth at length herein. 4 30. Plaintiffs are 'Persons" as defined by the Unfair Trade Practices and Consumer Protection Law at 73 P.S. §201-2(2). 31. Defendant is a"Person" as defined by 73 P.S. §201-2(2). 32. The Unfair Trade Practices and Consumer Protection Law at 201-9.2(a) of the Act authorizes a private cause of action for any person "who purchases or leases goods or services primarily for personal, family or household purposes." 33. A violation of the Pennsylvania Automobile Lemon Law automatically constitutes a violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Act, 73 P.S. 201-1 et§gq. 34. The Pennsylvania Unfair Trade Practices and Consumer Protection Act, 73 P.S. §201-2(4), defines "unfair or deceptive acts or practices" to include the following conduct: (vii). Representing that goods or services are of a particular standard,quality or grade, or that goods are of a particular style or model,if they are of another; (xiv). Failing to comply with the terms of any written guarantee or warranty given to the buyer at,prior to, or after a contract for the purchase of goods or services is made; (xv). Knowingly misrepresenting that services, replacements or repairs are needed if they are not needed; (xvi). Making repairs, improvements or replacements on tangible, real or personal property of a nature or quality inferior to or below the standard of that agreed to in writing; (xvii). Engaging in any other fraudulent or deceptive conduct which creates a likelihood of confusion or of misunderstanding. 35. Defendant's actions including but not limited to failing to provide a merchantable vehicle, failing to comply with the terms of its warranty and, failing to remedy the defects with the vehicle at no charge and failing to provide documentation of repair attempts have violated the Unfair Trade Practices and Consumer Protection Law. 5 36. The UTPCPL at 73 P.S. § 201-3.1 specifically authorizes the Attorney General to enact rules and regulations in support of the enforcement and administration of the UTPCPL, which rules and regulations shall have the force of law. 37. The Automotive Industry Trade Practices regulations, 37 Pa. Code § 301.2 were promulgated pursuant to the authority of 73 P.S. § 201-3.1. 38. Defendant's conduct in failing to provide documentation of warranty repair attempts violates the express terms of Section 301.5. Pennsylvania Automotive Trade Practices regulations which provide: General provisions—repair shop. With regard to a repair shop, the following is considered unfair methods of competition and unfair or deceptive acts or practices: . (8) Failing to provide a customer at the completion of repair or maintenance work, including warranty repair work,performed on the vehicle of the customer a dated, written invoice containing the following information: (i) The name and address of the customer and repair shop. (ii) The date the vehicle of the customer was delivered for service. (iii) The year, make and registration number of the vehicle of the customer and the odometer reading of the vehicle at the time the repairs were completed. (iv) An itemized list of the specific repair or maintenance services performed on the motor vehicle of the customer. (v) A list of the parts supplied by name or number, the price charged for the parts and the total amount charged the customer for the parts. (vi) If a part supplied was not new, a statement that the part was either used, reconditioned or rebuilt. (vii) The labor charge for the repair work, setting forth the number of hours,the price charged for each hour and the total amount charged the customer for labor. 6 (viii) The total amount charged to the customer for parts and labor; provided,however,that the price information required by this subparagraph and subparagraphs (v) and(vii) need not be provided if the price charged to the customer for the repair or maintenance work is a single charge for the particular service which charge was included in a schedule of charges posted in a clear and conspicuous manner on the premises of the repair shop or otherwise disclosed to the customer at the time the vehicle was delivered for service or repair.No other charges are permitted by this paragraph unless they are clearly and conspicuously disclosed to the customer prior to the commencement of repairs. 39. Plaintiffs have suffered damages as a result of Defendant's violations of the Unfair Trade Practices and Consumer Protection Law. 40. Plaintiffs are entitled to actual damages and treble damages for Defendant's violations of the Unfair Trade Practices and Consumer Protection Law. WHEREFORE, Plaintiffs respectfully demand judgment against Defendant in an amount not in excess of Fifty Thousand Dollars ($50,000), together with all collateral charges, attorneys' fees, all court costs and treble damages.
