Defendant(s) CIVIL ACTION - LAW COMPLAINT The Plaintiff, MITY-LITE, by its attorneys, KODAK LAW OFFICES, P.C., brings this action of Assumpsit against the Defendant(s) to recover the sum of THREE THOUSAND SIX HUNDRED THIRTY NINE DOLLARS AND SEVEN CENTS ($3,639.07), along with interest thereon at the statutory rate from May 10, 2013, together with any and all court costs incurred by Plaintiff, upon a cause of action of which the following is a statement: 1. The Plaintiff, MITY-LITE, is a corporation organized and existing under the laws of the State of Utah, having its principal office and place of business at 1301 West 400, North Orem, UT 84057. 2. The Defendant, CARLISLE SPORTS EMPORIUM, INC., is a corporation having its principal office and place of business at 29 S MIDDLESEX ROAD, CARLISLE, CUMBERLAND COUNTY, PENNSYLVANIA 17015. Defendant, CARLISLE SPORTS EMPORIUM, INC., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, as more fully set forth on the Pennsylvania Department of State Corporation Bureau print out attached hereto, marked Exhibit "A" and made a part hereof. 4. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff Statement of Account hereto attached, marked Exhibit "B" and made a part hereof, Plaintiff, at the special instance request of the Defendant(s), sold and delivered goods, wares and merchandise and/or performed labor and provided services of the kind and description set forth on said Exhibit to the total amount of Three Thousand Six Hundred Thirty Nine Dollars and Seven Cents ($3,639.07). 5. The prices charged for said goods, wares and merchandise and/or labor and services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant(s) promised and agreed to pay to Plaintiff. 6. The balance due and owing by Defendant(s) to Plaintiff is the sum of Three Thousand Six Hundred Thirty Nine Dollars and Seven Cents ($3,639.07), as appears by Plaintiff's Statement of Account hereto attached, marked as Exhibit"B" and made a part hereof.
