I, A. GRAYBILL BRUBAKER, a/k/a ALLEN GRAYBILL BRUBAKER,
currently of Upper Allen Township, Cumberland County, Pennsylvania, being of sound
mind and disposing memory, realizing the uncertainty of this life, but with confidence in
God and trust in His Son, my Lord and Savior, Jesus Christ, who died for my sins upon
the cross and rose again to redeem me and give me eternal life, do hereby make, publish
and declare this to be my Last Will and Testament, hereby revoking any and all prior
Wills and Codicils made by me.
I. I direct that all my just debts and funeral expenses be paid from the assets of my
estate as soon as practicable after my demise.
II. I direct that all estate and inheritance taxes that may be assessed in consequence
of my death, shall be paid out of the principal of my general estate to the same effect as if
said taxes were expenses of administration and all property includable in my taxable
estate whether or not passing under this Will shall be free and clear thereof.
III. In the event I still have an interest in premises known as Stone Mountain Farm
situated in Bradley Township, Huntington County, Pennsylvania, I grant unto my sons or
grandchildren the right to purchase my interest at one-half(1/2) of the fair market value
of said interest at the time of my death. If more than one of them desires to purchase said
interest, each shall submit a sealed bid to my Executor and the property shall be sold to
the highest bidder. If none of them are interested in purchasing it, it shall then be sold
pursuant to the terms of the most recent (as of my death) Agreement I have with the
owners of the remaining interest in the property.
IV. I bequeath unto my wife, Ethel S. Brubaker, all tangible personal property which
I own at my death.
V. All the rest, residue and remainder of my estate, of whatever nature and wherever
situate, including property over which I hold a power of appointment, I devise and
bequeath unto my wife, Ethel.
VI. In the event that my wife, Ethel, does not survive me, I devise and bequeath my
entire estate that would have otherwise passed under Paragraphs W and V above as
follows:
A. I bequeath unto our sons, Ray, Robert and Richard, any items
of my tangible personal property which they may desire and can agree
upon. Any items not so chosen shall pass as part of my residuary estate
below.
B. All the rest, residue and remainder of my estate, of whatever
nature and wherever situate, I devise and bequeath as follows:
(1) One-fourth (1/4) unto my son, Ray A.
Brubaker, or his issue per stirpes.
(2) One-fourth (1/4) unto my son, Robert L.
Brubaker, or his issue per stirpes.
(3) One-fourth (1/4) unto my son, Richard E.
Brubaker, or his issue per stirpes.
(4) One-fourth (1/4) unto the Brethren in Christ
Foundation, Grantham, Pennsylvania, to be used for the
charitable purposes in accordance with my recommendations
with it.
VII. I appoint my wife, Ethel S. Brubaker, Executrix of this my Will. In the event
that she fails to qualify or ceases to act as Executrix, I appoint my son, Ray A. Brubaker
as Executor of this my Will.
VIII. I direct that no bond be required of my fiduciary for the faithful performance of
his or her duties in any jurisdiction.

hand to this my Last Will, typewritten on three (3) sheets f paper including the

Dear Carl,
As you know, in grandpa's Will, he granted unto "my sons or grandchildren"the
right to purchase his share of the Stone Mountain Farm and the proceeds of such a sale
would pass to me as part of the residue of his estate. At that time the farm was not
producing income, so selling it and investing the proceeds would have been of greater
benefit to me.
Now, however, since they are "mining" the Farm, it would be of much greater
benefit to me with my expenses here at the Village to actually own the Farm, since the
proceeds from the"mining" are greater than income from investing the sales proceeds.
I am writing to see if each of you would be open to his interest in the Farm being
