COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff is Cenlar FSB, duly organized and doing business at the above - captioned address.
2. The Defendant is Unknown Surviving Heirs of Edward A. Ditty, Deceased Mortgagor and
Real Owner, and their last -known address is 9 Adams Street, Enola, PA 17025.
3. On October 5, 2007, Edward A. Ditty, mortgagor, made, executed and delivered a mortgage
upon the premises hereinafter described to Pennsylvania State Bank, a division of BLC Bank, N.A. which
mortgage is recorded in the Office of the Recorder of Cumberland County as Instrument Number 200739271
(the "Mortgage "), such Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C.
P.
4. On October 5, 2007, Edward A. Ditty, also executed a promissory note secured by the
aforementioned mortgage. Plaintiff, directly or through an agent, is in possession of the note and is the holder
of the note with the right to enforce it; the note is either made payable to plaintiff or has been duly endorsed.
5. On October 5, 2007, the Mortgage was assigned by Pennsylvania State Bank, a division of
BLC Bank, N.A. to Taylor, Bean & Whitaker Mortgage Corp., by Assignment of Mortgage, recorded in the
Office of the Recorder of Cumberland County as Instrument Number 200739272, such Assignment of
Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P.
6. On May 7, 2014, the Mortgage was assigned by Taylor, Bean & Whitaker Mortgage Corp.,
by Federal Home Loan Mortgage Corporation, its Attorney -in -Fact to Cenlar FSB, Plaintiff herein, by
Assignment of Mortgage, recorded in the Office of the Recorder of Cumberland County as Instrument
Number 201410503, such Assignment of Mortgage being incorporated herein by reference pursuant to Rule
1019(g) Pa. R. C. P.
7. On January 2, 2012, Edward A. Ditty departed this life. No estate has been opened as a result
of the demise of Edward A. Ditty, Deceased Mortgagor and Real Owner.
8. The premises subject to said mortgage is described in the legal description attached as Exhibit
"A" and is known as 9 Adams Street, Enola, Pennsylvania 17025.
9. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due April 1, 2012 and each month thereafter are due and unpaid, and by the terms of said mortgage,
upon default in such payments for a period of one month, the entire principal balance and all interest due
thereon are collectible forthwith.

10. The following amounts are due on the mortgage:

(Plus $3.42 per diem thereafter)

The attorney's fees set forth above are in conformity with the mortgage documents and Pennsylvania law,
and will be collected in the event of a third party purchaser at Sheriff's sale. If the mortgage is reinstated
prior to sale, reasonable and actually incurred attorney's fees will be charged in accordance with the
reduction provisions of Act 6, if applicable.
11. Plaintiff complied with all notice requirements as prescribed by 41 P.S. § 101, et seq. (Act
6), and 35 P.S. 1680.401c, et seq. (Act 91), as applicable.
12. This is an in rem action only against the aforesaid mortgaged premises. Plaintiff is not
seeking a judgment of personal liability against the Defendant, but reserves its right to do so in a separate
legal action if such right exists. If the Defendant has received a discharge of personal liability in a bankruptcy
proceeding, this action is in no way an attempt to re- establish such liability.
WHEREFORE, Plaintiff demands in rem Judgment against the Defendant in the sum of $72,588.60
together with interest at the rate of $3.42 per diem and other costs and charges collectible under the mortgage
and for the foreclosure and sale of the mortgaged property.

MOTION FOR SERVICE PURSUANT TO SPECIAL ORDER OF COURT
Plaintiff, Cenlar FSB, by its counsel, moves this Honorable Court for an Order directing
service of the Complaint and of all subsequent notices and pleadings that require personal service,
including Notice of Sheriff's Sale upon Defendant, Unknown Surviving Heirs of Edward A. Ditty
Deceased Mortgagor and Real Owner by mail and by posting the mortgaged premises and by
publication and in support thereof, avers the following:
1. Edward A. Ditty was an individual and is the sole record owner and mortgagor of the
premises that is the subject of Plaintiff's action in Mortgage Foreclosure.

2. The premises that is subject of this mortgage foreclosure action is 9 Adams Street,
Enola, Pennsylvania 17025 and is the last -known address of the decedent.
3. Edward A. Ditty is deceased, having departed this life on January 2, 2012. No estate
or administration has been opened as a result of the demise of Edward A. Ditty. As a result,
Unknown Surviving Heirs of Edward A. Ditty, Deceased Mortgagor and Real Owner have been
named as Defendants to this foreclosure action.
4. Plaintiff retained Attorney Outsourcing Support Services, Inc. to investigate the
identity of any additional heirs of Edward A. Ditty. No additional heirs were found. An Affidavit
of Good Faith Investigation setting forth the specific inquiries made and the results therefrom is
attached hereto, made a part hereof and marked as Exhibit "A."
5. Plaintiff has obtained a property search of the mortgage premises which indicates that

MEMORANDUM OF LAW
Pennsylvania Rule of Civil Procedure 430(a) specifically provides:
(a) If service cannot be made under the applicable rule the Plaintiff may move the court
for a special order directing the method of service. The motion shall be accompanied by an Affidavit
stating the nature and extent of the investigation which has been made to determine the whereabouts
of the defendant and the reasons why service cannot be made.
Furthermore, Pennsylvania Rule of Civil Procedure 430(b)(2) specifically provides:
(2) When service is made by publication upon the heirs and assigns of a named former
owner or party in interest, the court may permit publication against the heirs or assigns generally if
it is set forth in the complaint or an affidavit that they are unknown.

Plaintiff has been unable to identify and/or locate additional heirs of Edward A. Ditty.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter an Order
pursuant to Pennsylvania Rules of Civil Procedure 430 and 3129.2(D) directing service of the
Complaint by posting, publication and by mail and further directing that all subsequent Notices and
pleadings that require personal service may be served in this manner except that publication of the
Notice of Sheriff's Sale by the Sheriff set forth in Pa.R.C.P 3129.2(D) is legally sufficient and
Plaintiff need not republish the Notice of Sheriff's Sale.

served a true and correct copy of the Notice of the filing of the Complaint in Mortgage
Foreclosure upon the Defendant, Unknown Surviving Heirs of Edward A. Ditty, Deceased
Mortgagor and Real Owner, through publication in the Sentinel. A true and correct copy of the

June 3, 2015 at 10:00 a.m. in the Commissioner's Hearing Room located on the 2nd Floor of the Cumberland County
Courthouse, 1 Courthouse Square, Carlisle, Pennsylvania 17013 to enforce the court judgment of $72,879.30 obtained by Cenlar
FSB against you.
NOTICE OF OWNER'S RIGHTS

1. The sale will be canceled if you pay to Cenlar FSB the back payments, late charges, costs, and reasonable

2. You may be able to stop the sale by filing a petition asking the Court to strike or open the judgment, if the
judgment was improperly entered. You may also ask the Court to postpone the sale for good cause.

EVEN IF THE SHERIFF'S SALE DOES TAKE PLACE
1. If the Sheriffs Sale is not stopped, your property will be sold to the highest bidder. You may find out the price
bid by calling McCabe, Weisberg and Conway, P.C., Esquire at (215) 790-1010.
2. You may be able to petition the Court to set aside the sale if the bid price was grossly inadequate compared to
the value of your property.
3. The sale will go through only if the buyer pays the Sheriff the full amount due on the sale. To fmd out if this
has happened, you may call McCabe, Weisberg and Conway, P.C. at (215) 790-1010.
4. If the amount due from the buyer is not paid to the Sheriff, you will remain the owner of the property as if the
sale never happened.
5. You have a right to remain in the property until the full amount due is paid to the Sheriff and the Sheriff gives
a deed to the buyer. At that time, the buyer may bring legal proceedings to evict you.
6. You may be entitled to a share of the money which was paid for your real estate. A schedule of distribution of
the money bid for your real estate will be filed by the Sheriff within thirty (30) days of the sale. This schedule
will state who will be receiving that money. The money will be paid out in accordance with this schedule
unless exceptions (reasons why the proposed schedule of distribution is wrong) are filed with the Sheriff
within ten (10) days after the posting of the schedule of distribution.
7. You may also have other rights and defenses, or ways of getting your real estate back, if you act immediately
after the sale.
