COMPLAINT
1. Plaintiff, Portfolio Recovery Associates, LLC is a Delaware Limited Liability Company with
offices located at 120 Corporate Blvd, Norfolk, VA 23502.
2. Defendant, DAVID FLAIG, is an adult individual with last known address of 5775 ASPEN LN,
ENOLA PA 17025.
3. It is averred that Defendant was indebted to GE CAPITAL RETAIL BANK/AMAZON on
November 24, 2011 with account number ************5549 (hereafter referred to as
"Account").
4. By using the Account, Defendant agreed to repay any incurred balances and/or charges made to
the Account pursuant to the terms and conditions governing said Account. Failure to pay
Defendant's incurred charges on the Account is considered a default.
5. At all relevant times material hereto, Defendant has used said Account for the purchase of
products, goods and/or for obtaining services.
This cominunication is froin a debt collector and is an attempt to collect a debt.
Any information obtained will be used for tliat purpose.
6. Defendant was provided with copies of the Statements of Account showing all debits and credits
for transactions on the aforementioned Account to which there was no bonafide objection by
Defendant. A copy of the charge off statement is attached hereto and collectively marked as
Exhibit "A."
7. Defendant was in default with respect to that debt for failure to make the required payments on
the Account. The last payment made on this Account was on March 1, 2013.
8. Plaintiff is the purchaser, assignee and/or successor in interest GE CAPITAL RETAIL BANK/
AMAZON and Plaintiff is now the holder of the Account. A true and correct copy of the
Plaintiffs Bill of Sale is attached hereto and collectively marked as Exhibit "A."
9. As of the date within Complaint, the remaining balance due, owing and unpaid on Defendant's
Account, as a result of Defendant and/or any authorized user's use of said Account is in the sum
of$861.30. f
10. Despite reasonable and repeated demands for payment. Defendant has refused and continues to
refuse to pay all sums due and owing on the aforementioned Account, all to the damage and
detriment of the Plaintiff.
11. The amount in controversy is within the jurisdictional amount requiring compulsory arbitration.
WHEREFORE, Plaintiff respectfully requests this Honorable court enter Judgment in favor of
Plaintiff and against Defendant, DAVID FLAIG , in the amount 861.30, plus costs of this action and
any other relief as the Court deems just and reasonabl

PRELIMINARY OBJECTIONS OF DEFENDANT
Defendant, DAVID FLAIG, by and through counsel of Andrew C.
Sheely, Esquire, hereby files these preliminary objections to
Plaintiff's Complaint and respectfully states as follows:
1. David Flaig (hereinafter referred to as "Defendant") is
an adult individual named as defendant in the above -captioned
matter.
2. Plaintiff's Complaint is in the nature of allegations
of a breach of contract or agreement by Defendant.
3. Plaintiff's complaint
about September 17, 2014.
4. Plaintiff's complaint
was served on Defendant on or
includes/attaches a copy of a
general credit account statement addressed to Defendant and a
purported Bill of Sale executed on behalf of entities not a
party to the above referenced cause of action, with the
exception of Plaintiff.
5. Plaintiff's complaint fails to attach any written
agreement executed by Defendant David Flaig supporting any
allegation of breach of agreement as required by Pa. R.C.P. No.
1019(1).
6. Plaintiff's complaint should be dismissed in its
entirety pursuant to Pa. R.C.P. No. 1028(a)(4) in the absence of
a signed contract or agreement authorizing collection of any
amount, including interest charges set forth on the exhibit.
7. Plaintiff's complaint fails to comply with Pa. R.C.P.
No. 1028 (a)(6) by failing to advise the Court of the existence
or non-existence of arbitration provisions in the alleged
agreement between Plaintiff and Defendant, including whether or
not Plaintiff has considered arbitration in accordance
therewith.
8. Plaintiff's complaint fails to comply with Pa. R.C.P.
No. 1028 (a)(4) by failing to allege with specificity the
original amount of the alleged credit card debt, the amount of
any payments made by Defendant against the alleged credit card
debt and terms of payment supporting any claim for breach of
agreement on account of the alleged credit card debt owing
Plaintiff from Defendant.
9. Plaintiff's complaint fails to provide sufficient
factual allegations in support of any cause of action to enable

Defendant to frame a proper answer and defense as required by
Pa. R.C.P. No. 1028 (a)(3), including other preliminary
objections authorized by the applicable Pennsylvania Rules of
Civil Procedure.
WHEREFORE, Defendant respectfully requests that this
Honorable Court direct that Plaintiff amend its Complaint so as
to comply with the Pennsylvania Rules of Civil Procedure,
including the attachment of an applicable Agreement with terms
supporting a claim for breach of agreement, or in the
alternative, dismiss the Complaint as improperly filed.
