�Q� N�y 2� 1�, Judge Hess appointed the Cumberland County Aging and
��mr�nity �er�es Permanent Plenary Guardian of Person and Estate for Lavita
w I�ckel�- Prior`t'o�e guardianship hearing, Lavita was taken by Aging Staff to a Domestic
`�Viole�e shelter ecause she had been assaulted by her grandson. She was later
`� transported to Claremont Nursing and Rehab Center because she required more care
than the shelter could provide. At the time of the hearing, Ms. Nickel was still a resident
of the Claremont Nursing Rehabilitation Center where she resided until her death.
At the time of her admission, her diagnoses were insulin dependent diabetes,
neuropathy, acute anxiety, chronic paresthesias of extremities, hypothyroidism,
hypertension, dermatitis. She was later diagnosed with depression, dysphasia,
dementia, gait dysfunction, weakness, left intertrochanteric hip fracture with repair,
agitation, arteriosclerotic disease, macular degeneration, and urinary tract infections.
In June 2014 Lavita was started on an anti-biotic because of cellulitis in her right leg.
They also gave her a one-time dose of Lasix in an attempt to reduce the swelling.
Lavita continued to decline mainly because of her skin disorders that left her open to
infections, problems with blood sugar levels, and made Prednizone a constant needed
drug. On one day her sugar was recorded at 513 at night and 39 the next morning.
This also affected her behavior toward others.
There is a DNR order in place and starting in August, she was placed on comfort
measures only. Family was updated as to her condition. Lavita was put on an antibiotic
for her blisters on her legs due to an autoimmune failure. She continued to decline and
was no longer able to carry on a conversation or make her needs known.
Lavita continued to decline and on August 22 her skin was showing mottling of the lower
extremities, a sign that her body was shutting down. She passed away on August 27,
2014. Her cremains were buried at the Cumberland Valley Memorial Gardens next to
her husband and daughter. Two staff members from the Agency attended the funeral.
Her son and 3 grandchildren were also in attendance.

Guardian of Estate
At the time of the guardianship, Ms. Nickel had a checking account at Adams County
National Bank in Newville, PA with a balance of $2625.14. This account was later
closed and a guardianship account was opened at F&M Bank.
Her only income was Social Security which was $1175 a month. The monthly amount
paid to Claremont Nursing and Rehab Center was approximately $1040.00 a month.
Cumberland County Aging was paid $100 a month for a guardianship services as
provided by the court order.
At the time of the guardian appointment, we knew of no relatives with any information
concerning funeral arrangements. Aging made pre-arranged funeral arrangements with
Hollinger's Funeral Home which included burial in Mt. Holly Cemetery. In August, we
received a call from her son William. He explained that his father and sister's remains
are at Cumberland Valley Memorial Gardens. His parents had made these
arrangements back in the 90's and he would like to honor his mother's wishes. He was
not available to talk to when we became guardian because he had been incarcerated
for 4 years. We worked with both Cumberland Valley Memorial Gardens and Hollinger
Funeral Home about changing the arrangements. The difference in opening and closing
costs for the 2 cemeteries was $1140.00. Fortunately, Lavita had this amount in her
checking account and the arrangements were made. This left a balance in her account
of$53.17. No report will be necessary to the Estate Recovery Office because the
balance is below $2400.

attached is a spread sheet representing her checking account register.
