The sums paid to Shippensburg University Foundation, Inc. from Decedent's IRA's fully funded the amounts described in ITEM I1.A. and B, so no further distributions are required under ITEM III.A. I1. Calculation of Pecuniary Bequests under Item III B. of Last Will and Testament. The formula for the pecuniary bequests under Item III B resulted in the sum of $100,000.00 being paid to each named beneficiary. Per Item III B. 8% x $6,253,741.00(residual estate) =$500,299.28 which is more than $100,000.00. The Will directed payout of the lesser amount(i.e. $100,000.00). Rider to Paragraph 14. III. Decree of Distribution Rather Than Appointment of Successor Executor. For the information of the Court,the Executrix,Elsie W. Swenson, died June 12, 2014, a resident of Cumberland County, Pennsylvania. Robert Woodring has been appointed Executor of the Estate of Elsie W. Swenson by the Register of Wills of Cumberland County,Pennsylvania. Orrstown Bank is named as successor Executor to Elsie W. Swenson. By the time of her death,Mrs. Swenson had filed the Pennsylvania Inheritance Tax and Federal Estate Tax returns for the Rife Estate, paid all taxes, satisfied all pre-residual bequests (except the bequest to Colonial Williamsburg Foundation), and made a substantial distribution on account of the residue of Decedent's Estate, all as reported in the First and Final Account. The administration of the Rife Estate is essentially complete,except for filing an accounting, paying the final reserves for expenses, paying the bequest to the Colonial Williamsburg Foundation and distributing the residue to the Shippensburg University Foundation, Inc. Under 20 Pa. C.S.A. § 3324, this Court has the authority to direct the Executor of the deceased Executrix's estate to turn over all assets to the successor Executor for further administration, or to pay the reserves and make distribution of the remaining assets to the named heirs. (See In re German's Estate, 60 A. 720 (Pa. 1905)). Since the administration of decedent's estate is essentially complete,Petitioner proposes that it is in the best interests of the Estate and its beneficiaries for this Court to direct Petitioner to pay the reserves and make the distributions shown in the proposed distribution.
