on the Properties.
49. At the time of entering into the Contracts, Defendants were in the business of home
renovations and made various implied warranties as to the final product, i.e. the renovations.

expecting a minimum level of quality, workmanship, and completeness of the construction of the
renovations, free of defects.
50. Plaintiffs relied upon the skill and judgment of the Defendants in entering into the
Contracts.
51. Defendants breached their implied duty of merchantability and fitness because
Defendants' construction and installations were faulty, and improper, and have caused or created
damage to the Properties.

warranty, but Defendants failed to cure the numerous issues.
53. As a direct and proximate result of Defendants' breach of warranty, Plaintiff's sustained
