Dear Lisa:
In accordance with your request for a document for the record, this will confirm
that, on September 4, 2014, the auditor requested deposits of$1,500 from each of the
parties on account of the fees and expenses of audit in lieu of the auditor's filing of a
petition for the posting of security.
In this same email to the parties, the auditor clarified to the parties that there
would be no guarantee that the auditor's fees and expenses would be limited by the
suggested $1,500 amount of the deposit.
With respect to the issue of poundage, in the previous administration, poundage
was not assessed against security deposits for auditor's fees and expenses. That was on
the basis of the opinion of the previous solicitor.
If it would be necessary to file a petition concerning security for fees and expenses
under Orphans' Court Rule 8.8, it would certainly be expected that the judge would be
receptive to confirmation that such deposits would not be subject to poundage.
Therefore, if you see the need to revisit that, please let us know if Mr. Pecht does not
agree with that approach so that we can give the parties the option of depositing those
funds in escrow with this office.
