MECHANICS' LIEN CLAIM Warfel Construction Company ("Warfel"), by and through its counsel, Harmon & Davies, P.C., files this Mechanics' Lien Claim as a contractor, pursuant to the Mechanics' Lien Law of 1963, 49 P.S. § 1101, et seq., against the property herein described, and any and all buildings erected thereupon, and the curtilage appurtenant thereto, for payment of$150,366.00, and in support thereof avers as follows: 1. Claimant, Warfel, is a Pennsylvania corporation, with its principal place of business at 1110 Enterprise Road, East Petersburg, Pennsylvania 17520. 2. Respondent, Mechanicsburg Real Estate Company, LP, is a limited partnership registered with the Commonwealth of Pennsylvania with a registered office address of 4550 Lena Drive, Suite 225, Mechanicsburg, Pennsylvania 17055. 3. The Respondent is the record owner of real property situated in Cumberland County at an address known as 707 Shepherdstown Road, Mechanicsburg, Pennsylvania 17055 ("the Property"). A true and correct copy of the legal description of the property is attached hereto as Exhibit A. * 4. Warfel files this Mechanics' Lien Claim as a contractor who contracted directly with the Owner, Respondent,for improvements of the Property. . 5. On or about November 9, 2012, Warfel and Respondent entered a written contract ("the Contract") whereby Warfel was to furnish labor and materials to improve the Property. 6. The Contract provided that Warfel was to construct a new one-story senior care facility consisting of a Skilled Nursing facility and a Personal Care facility. This construction is referred to as "the Project." A true and correct copy of the Contract is attached hereto as Exhibit B. The specific scope of work shown in the Contract is incorporated herein as if set forth in full detail. 7. On or about November 19, 2012, Warfel began furnishing labor and materials to the Property for the purpose of the Project. 8. The original Contract sum was $7,823,115.00. 9. Change orders were agreed upon, increasing the contract price by $385,114.00 to a grand total of$8,208,229.00 as the contract sum. 10. Warfel has performed the Contract work. 11. The last date of furnishing labor or materials was August 14, 2014. 2 12. To date, Respondent has made payments totaling $8,057,863.00; thus, it failed to pay the full amount owed on the contract. 13. To date, $150,366.00 is still owed, outstanding, and due on the contract. A true and correct copy of the payment applications evidencing the outstanding amount owed is attached hereto as Exhibits C and D. 14. Pre judgment interest on the amount owed is calculated as follows: a. $104,847.70 was due on May 25, 2014 and carries interest at the rate of 6 percent per year from that due-date forward. b. $45,518.30 was due on September 7, 2014 and carries interest at the rate of 6 percent per year from that due-date forward. 15. Warfel contacted Respondent demanding payment on the owed amount. The Respondent has refused to pay. 16. For the amount due, $150,366.00, plus interest at the above specified rates, Warfel claims a lien on the Property, and all improvements and buildings located on the Property. COMPLAINT IN ACTION UPON MECHANICS' LIEN NOW COMES the Plaintiff, Warfel Construction Company ("Warfel"), by and through its counsel, Harmon & Davies, P.C., and files this Complaint in Action Upon Mechanics' Lien as a contractor, pursuant to the Mechanics' Lien Law of 1963, 49 P.S. § 1101, et seq., and the Pennsylvania Rules of Civil Procedure 1651 et seq., and, in support thereof, avers as follows: 1. Plaintiff, Warfel, is a Pennsylvania corporation, with its principal place of business at 1110 Enterprise Road, East Petersburg, Pennsylvania 17520. 2. Defendant, Mechanicsburg Real Estate Company, LP, is a limited partnership registered with the Commonwealth of Pennsylvania with a registered office address of 4550 Lena Drive, Suite 225, Mechanicsburg, Pennsylvania 17055. 3. The Defendant is the record owner of real property situated in Cumberland County at an address known as 707 Shepherdstown Road, Mechanicsburg, Pennsylvania 17055 ("the Property"). A true and correct copy of the Deed to the Property is attached hereto as Exhibit A. 4. Warfel files this Complaint as a contractor who contracted directly with the Owner, Defendant, for improvements of the Property. 5. This Complaint commences an action to obtain judgment upon the Mechanics' Lien Claim, which was filed on September 22, 2014 in the Court of Common Pleas of Cumberland County, Pennsylvania, with a docket no. 14-5587, and a copy of the docketed Mechanics' Lien Claim is attached hereto as Exhibit B. 6. On September 26, 2014, the Mechanics' Lien Claim was served upon the Defendant, and a Sheriff's Return of Service was filed under docket no. 14-5587 on October 3, 2014. 7. On or about November 9, 2012, Warfel and the Defendant entered a written contract ("the Contract") whereby Warfel was to furnish labor and materials to improve the Property. 8. The Contract provided that Warfel was to construct a new one-story senior care facility consisting of a Skilled Nursing facility and a Personal Care facility. This construction is referred to as "the Project." A true and correct copy of the Contract is part of the Mechanics' Lien Claim attached to this Complaint, and the scope of work, shown in the Mechanics' Lien Claim and its attachments, is incorporated herein as if set forth in full. 9. On or about November 19, 2012, Warfel began furnishing labor and materials to the Property for the purpose of the Project. 2 10. The original Contract sum was $7,823,115.00. 11. Change orders were agreed upon, increasing the contract price by $385,114.00 to a grand total of$8,208,229.00 as the contract sum. 12. Warfel has performed the Contract work. 13. Warfel performed the work in a good and workmanlike manner and in accordance with the Contract. 14. At no time during the course of the Project did Defendant terminate Warfel. 15. The last date of furnishing labor or materials was August 14, 2014. 16. To date, Respondent has made payments totaling $8,057,863.00; thus, it failed to pay the full amount owed on the contract. 17. To date, $150,366.00 is still owed, outstanding, and due on the contract. A true and correct copy of the payment applications evidencing the outstanding amount are attached to the Mechanics' Lien Claim, attached to this Complaint. 18. Pre judgment interest on the amount owed is calculated as follows: a. $104,847.70 was due on May 25, 2014 and carries interest at the rate of 6 percent per year from that due-date forward. b. $45,518.30 was due on September 7, 2014 and carries interest at the rate of 6 percent per year from that due-date forward. 19. Warfel contacted the Defendant demanding payment on the owed amount. The Defendant has refused to pay. Warfel files this Mechanics' Lien Claim as a contractor who contracted directly with the Owner, Respondent, for improvements of the Property. 5. On or about November 9, 2012, Warfel and Respondent entered a written contract ("the Contract")whereby Warfel was to furnish labor and materials to improve the Property. 6. The Contract provided that Warfel was to construct a new one-story senior care facility consisting of a Skilled Nursing facility and a Personal Care facility. This construction is referred to as "the Project." A true and correct copy of the Contract is attached hereto as Exhibit B. The specific scope of work shown in the Contract is incorporated herein as if set forth in full detail. 7. On or about November 19, 2012, Warfel began furnishing labor and materials to the Property for the purpose of the Project. 8. The original Contract sum was $7,823,115.00. 9. Change orders were agreed upon, increasing the contract price by $385,114.00 to a grand total of$8,208,229.00 as the contract sum. 10. Warfel has performed the Contract work. 11. The last date of furnishing labor or materials was August 14, 2014. 2 12. To date, Respondent has made payments totaling $8,057,863.00; thus, it failed to pay the full amount owed on the contract. 13. To date, $150,366.00 is still owed,outstanding, and due on the contract. A true and correct copy of the payment applications evidencing the outstanding amount owed is attached hereto as Exhibits C and D. 14. Pre judgment interest on the amount owed is calculated as follows: a. $104,847.70 was due on May 25, 2014 and carries interest at the rate of 6 percent per year from that due-date forward. b. $45,518.30 was due on September 7, 2014 and carries interest at the rate of 6 percent per year from that due-date forward. 15. Warfel contacted Respondent demanding payment on the owed amount. The Respondent has refused to pay. 16.
