Ginger Riland (hereafter "Plaintiff') is an individual residing at 74 Keefer Way, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. William Stauffer (hereafter "Defendant") is an individual residing at 100 S. 15th Street, Camp Hill, PA 17011. 3. This Complaint is filed in response to Defendant's Appeal of a judgment entered in Cumberland Co. MDJ Court 09-3-05, cause number MJ -09305 -CV -0000073-2014. 4. On or about May 1, 2013, Plaintiff reported a theft of equipment and power tools that happened at an indeterminate time shortly before the report was made. 5. The stolen items included tools owned by Plaintiff and tools owned by Defendant in the operation of his grounds maintenance business. 6. Plaintiff was reimbursed amount through her home owners insurance policy to replace her tools which were stolen. 7. The Defendant did not have insurance to replace his items which were stolen. 8. Plaintiff allowed Defendant to use her tools for the operation of his grounds maintenance business. 9. Plaintiff and Defendant entered into an oral agreement where Plaintiff opened a Home Depot charge account and allowed Defendant to purchase additional items under the agreement that Defendant would pay the monthly bill until paid -off . 8. As shown above, the amount of Plaintiff purchases is $3,174.55. 10. Defendant did make payments totaling $700 but now refuses to honor the agreement and make the remaining payments as agreed. WHEREFORE, Plaintiff respectfully requests this Court grant judgment in her favor and against Defendant in the amount of $2,474.55 as well as all costs of court.
