is 3 percent 172 P.S.§9116(a)(1,1)(1)).
For dates of death on or after Jan. 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S.§9116(a)(1,1)(ii)].The statute does not exempt a transfer to a surviving spouse from tax,and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1,2000:
• The tax rate imposed on the net value of transfers from a deceased child 21 years of age or younger at death to or for the use of a natural parent,an
adoptive parent or a stepparent of the child is 0 percent 172 PS.§9116(a)(1.2)].
• The tax rate imposed on the net value of transfers to or for the use of the decedents lineal beneficiaries is 4.5 percent,except as noted in F2 P.S.§9116(a)(1)].
• The tax rate imposed on the net value of transfers to or for the use of the decedents siblings is 12 percent[72 P.S.§9116(a)(1.3)].A sibling is defined,
under Section 9102,as an individual who has at least one parent in common with the decedent,whether by blood or adoption.

County, Pennsylvania, being of sound and disposing mind, memory and understanding,
do hereby make, publish and declare this as and for my Last Will and Testament,
hereby revoking all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, including
Q my grave marker, shall be paid from the assets of my estate as soon as practicable after

U SECOND: I give and bequeath my cedar chest to my Daughter,
x SUSAN M. KEARNAN.

. v THIRD: I give, devise and bequeath the residue of my estate, of every
nature and wherever situate, to my Husband, ALBERT R. HOCKENSMITH, providing
he shall survive me by thirty (30) days. Should my Husband, ALBERT R.
HOCKENSMITH, predecease me or die on or before the thirtieth day following my
death, I give, devise and bequeath the residue of my estate, of every nature and
wherever situate, to my Son, ROGER L. HOCKENSMITH, provided that should he
predecease me or die on or before the thirtieth day following my death, his share shall
be distributed to his issue equally living on the thirty-first day following my death.
FOURTH: No provision is made in this will for my Son, EUGENE A.
HOCKENSMITH, not because of any lack of affection or love for him, but because I
have already provided for him during my lifetime.
FIFTH: No provision other than the specific bequest provided in j
Paragraph Second is made in this will for my Daughter, SUSAN M. KEARNAN, not
because of any lack of affection or love for her, but because she is well provided for in
her own right.

SIXTH. I direct that all taxes that may be assessed in consequence of
my death, of whatever nature and by whatever jurisdiction imposed, shall be paid from 1
my residuary estate as a part of the expense of the administration of my estate.

DEFINITION OF MARKET VALUE: The most probable price which a property should bring in a(nmpetNe and open
market under all conditions requisite to a fair sale,the buyer and seller, each acting prudently, knowledgeably and
assuming the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of
a specified date and the passing of title from seller to buyer under conditions whereby: (3) buyer and seller are
typically motivated; 2) both parties are well informed of well advised,and each acting in what he considers his own
best interest;(3)a reasonable time is allowed for exposure in the open market; (4) payment is made in terms of cash
in U.S_dollars or in terms of financial arrangements comparable thereto; and (5) the price represents the normal
consideration for the property sold unaffected by special or creative financing or sales concessions'granted by
anyone associated with the sale.
' Adjustments to the comparable$must be made for special or creative financing at sales concessions.No adjust-
ments are necessary tot those costs which are normally paid by sellers as a result of tradition or law in a market area;
these costs are readily identifiable since the setter pays these costs in virtually at!sales transactions.Special or
creative financing adjustments can be made to the comparable property by comparisons to financing terms offered
by a third party Institutional lender that Is not already involved in the property or transaction.Any adjustment should
not be calculated on a mechanical dollar for dollar cast of the financing or concession but the dollar amount of any
adjustment should approximate the market's reaction to the financing or concessions based on the inspector's
