WITNESSETH,that in consideration of ONE DOLLAR AND NO ONE
HUNDREDTHS ($ 1.00) DOLLARS,in hand paid, the receipt whereof is hereby
acknowledged,the said Grantor does hereby grant and convey to the said Grantee, its
successors and assigns;
WHEREAS the said Norman L. Plank aWa Norman L, Plank,Jr., was the owner
of a certain lot and or parcel of land together with the buildings and improvements
thereon erected in Mt Holly Springs, Cumberland County, Pennsylvania, and being so
thereof seised departed this life on June 29, 2014.
WHEREAS,Letters of Testamentary in said estate were duly issued by the
Register of Wills in and for Cumberland County, Pennsylvania, wherein Teri Zeigler
was appointed Executrix at Estate No.21-14-0624: and
WHEREAS, Letters Testamentary remain in full force and effect; and
WHEREAS, the within sale is made pursuant to Section 3351 of the Probate,
Estate and Fiduciaries Code.
ALL those two (2) tracts or parcels of land situated in the Borough of Mount Holly
Springs, Cumberland County, Pennsylvania, being more particularly described as
follows:
TRACT 1:
BEGINNING at an iron pin, the northeastern corner of land now or formerly of Orr N.
Brenneman; thence by said land, South 85 degrees West 112 feet to an iron pin, the
northwestern comer of said land now or formerly of Orr N. Brenneman; thence North 5
degrees West 125 feet to an iron pin; thence by the same, North 85 degrees East 112 feet
to an iron pin; thence by the same South 5 degrees East 125 feet to the Place of
BEGINNING.
TOGETHER with a right-of-way 23 feet wide, along the western side of the tract of land
herein conveyed, from the northern line thereof, in a southerly direction to the alley
extending from East Pine Street northwardly to and along the eastern line of land now or
formerly of Helen Jane Ely; said right-of-way to be used in common with others,
thereunto entitled.
TRACT 2:
BEGINNING at an iron pin on the eastern side of Brenely Lane (23 feet wide) at the
dividing line between Lots Nos. 1 and 2 as shown on the hereinafter mentioned Plan of
Lots, said pin also marking a corner common to other lands of the Grantees herein, and
lands now or formerly of Orr N. Brenneman; thence along said dividing line between
Lots. I and 2, South 85 degrees West a distance of eighty-four and sixty one-hundredths
(84.60) feet to a point in Mountain Creek; thence in and down said Mountain Creek, the
following two (2) courses and distances:
(1)North 15 degrees 30 minutes East, a distance of one hundred eighty and twenty-eight
one-hundredths (180.28) feet to a point; and (2) North 01 degree East, a distance of one
hundred eighty-five and forty-three one-hundredths (185.43) feet to a point in said Creek;
thence along lands of Hempt Brothers, Inc., up Tail Race from Lower Mill, South 43
degrees 38 minutes 30 seconds East, a distance of three hundred seventy-four and sixty-
four one hundredths(374.64) feet to a point in the same corner of lands of Charles M.
Omer; thence along said lands now or formerly of Charles M. Omer, South 09 degrees 03
minutes East, a distance of sixty-one and two one-hundredths ( 61.02) feet to an iron pin
at the dividing line between Lots Nos. 1 and 3 as shown on the Plan of Lots hereinafter
mentioned thence along said dividing line between Lots Nos. I and 3, South 85 degrees
West, a distance of one hundred twenty-four and nineteen one hundredths (124.19) feet to
an iron pin at comer common to other lands of the Grantees herein, and lands now or
formerly of Orr N. Brenneman; thence along said other lands of the Grantees herein, the
following (3) courses and distances: (1)North 05 degrees West a distance of one hundred
twenty-five (125) feet to an iron pin; (2) South 85 degrees West, a distance of one
hundred twelve (112) feet to an iron pin; and (3) South 03 degrees East, a distance of one
hundred twenty-five (125) feet to an iron pin on the eastern side of Brenely Lane first
mentioned above at the dividing line between Lots No. 1 and 2 as shown on the Plan of
Lots hereinafter mentioned, the place of BEGINNING.
BEING LOT NO. 1 as shown on the Plan of Lots entitled "Final Subdivision PIan for
Lynn G. Brenneman, Sr.", dated September 7, 1976 (revised June 29, 1977 and recorded
in the Office of The Recorder of Deeds in and for Cumberland County, Pennsylvania, in
Plan Book 31, page 118.
TOGETHER with the free uninterrupted right of passage in, over, across and through
Brenely Lane (23 feet wide) as shown on the Plan of lots mentioned hereinabove over
Lots Nos. 2 and 4 in common with the owners of Lot Nos. 2,3,4 and 5 as shown on said
Plan of Lots their respective heirs and assigns, together with the right to use, maintain,
repair and replace water and sanitary sewer lines in common with the owners of Lot Nos.,
2, 4 and 5, their respective heirs and assigns, located in said Brenely lane as shown on
said Plan of Lots.
TOGETHER with the free and uninterrupted right of passage in, over, across and
through a certain easement twenty(20) feet in width as shown across Lot Nos. 3 and 5 on
the Plan of Lots mentioned hereinabove extending from an existing sixteen (I6)feet wide
reserved alley on the south to said Lot No. I on the north in, in common with the owners
of said Lot Nos. 3 and 5, their respective heirs and assigns.
THIS DEED-IN LIEU of foreclosure is given by the Grantors in connection with their
deed from Robert B. Wicks and Lucy J. Wicks, husband and wife, by deed dated
November 4, 2005, and recorded November 10, 2005 in the Recorder of Deeds in and for
Cumberland County Pennsylvania in Deed Book 271, Page 4551, granted and conveyed
unto Norman L. Plank, and Frances J. Plank, alk/a F. Jean Plank,husband and wife. The
said Frances J. Plank, a/k/a F. Jean Plank died September 24, 2009,thereby vesting title
to Norman L, Plank.
MORTGAGE: Norman L. Plank and F. Jean Plank, husband and wife to Orrstown
Bank, of 2695 Philadelphia Avenue, Chambersburg, Pennsylvania, dated October 30,
2006 and recorded November 6, 2006 in Mortgage Book 1472, page 0001, secure Three
Hundred Eighty-Five Thousand Dollars and No One Hundredths ($385,000.00)
AND the said Grantor covenants and agrees that she will warrant Specially the property
hereby conveyed.

I, norman 1 plank jr, a resident of the State of Pennsylvania, make, publish and
declare
this to be my Last will and Testament, revoking all wills and codicils at any
time heretofore made by me.
FIRST: I direct that the expenses of my last illness and funeral , the expenses
of the administration of my estate, and all estate, inheritance and similar
taxes payable with respect to property included in my estate, whether or not
passing under this will , and any interest or penalties thereon, shall be paid
out of my residuary estate, without apportionment and with no right of
reimbursement from any recipient of any such property.
SECOND: I am not married. I have the following children:

sean andrew plank, born on 09-30-1971
THIRD: I give all tangible personal property owned by me at the time of my
death, including without limitation personal effects, clothing, jewelry,
furniture, furnishings, household goods, automobiles and other vehicles,
together with all insurance policies relating thereto, to those of my children
who survive me, in substantially equal shares, to be divided among them as they
shall agree,
or if they cannot agree, as my Executor shall determine. All costs incurred by my
Executor in
connection with obtaining possession, appraising, safeguarding, delivering or
selling such property shall be paid as expenses of administering my estate.
FOURTH: I give all the rest, residue and remainder of my property and estate,
both real and personal , of whatever kind and wherever located, that I own or to
which I shall be in any manner entitled at the time of my death (collectively
referred to as my "residuary estate") , as follows:
(a) To those of my children who survive me and to the issue who survive me of
those of my children who shall not survive me, per stirpes.
(b) if there shall be no issue of mine then living, I give my residuary estate to
those who would take from me as if I were then to die without a will , unmarried
and the absolute owner of my residuary estate, and a resident of the state of
Pennsylvania.
FIFTH: If any property of my estate vests in absolute ownership in a minor or
incompetent, my Executor, at any time and without court authorization, may:
distribute the whole or any part of such property to the beneficiary; or use the
whole or any part for the health, education, maintenance and support of the
beneficiary; or distribute the whole or any part to a guardian, committee or
other legal representative of the beneficiary, or to a custodian for the
beneficiary under any gifts to minors or transfers to minors act, or to the
person or persons with whom the beneficiary resides. Evidence of any such
distribution or the receipt therefore executed by the person to whom the
distribution is made shall be a full discharge of my Executor from any liability
with respect thereto, even though my Executor may be such person. If such
beneficiary is a minor, my Executor may defer the distribution of the whole or
any part of such property until the beneficiary attains the age of twenty-one
(21) years, and may hold the same as a separate fund for the beneficiary with
all of the powers described in Article SEVENTH hereof. if the beneficiary dies
before attaining said age, any balance shall be paid and distributed to the
estate of the beneficiary.

SIXTH: I appoint teri sue zeigler to be my Executor. If teri sue zeigler does not
survive me, or shall fail to qualify for any reason as my personal
representative, or having qualified shall die, resign or cease to act for any
reason as my executor, I appoint todd allen plank as my Executor. To the extent
permitted by the laws of the State of Pennsylvania, this will is intended as and
shall be construed to be a nonintervention will and, after the probate of this
will , no further proceedings in court shall be necessary other than to comply
with the statutes relating to the handling of estates under nonintervention
wills. No bond or surety or other security shall be required of any Personal
Representative serving hereunder. The decision to administer my estate
independently or under court supervision shall be made solely by my personal
representative.
SEVENTH: I grant to my Executor all powers conferred upon executors wherever my
Executor may act. I also grant to my Executor power to retain, sell at public or
private sale, exchange, grant options on, invest and reinvest, and otherwise
deal with any kind of property, real or personal , for cash or on credit; to
borrow money and encumber or pledge any property to secure loans; to divide and
distribute property in cash or in kind; to exercise all powers of an absolute
owner of property; to compromise and release claims with or without
consideration; and to employ attorneys, accountants and other persons for
services or advice. The term "Executor" wherever used herein shall mean
the executors, executor, executrix or administrator in office from time to time.
EIGHTH: I direct that for purposes of this will a beneficiary shall be deemed to
predecease me unless such beneficiary survives me by more than thirty days. The
terms "child", "children" and "issue ', as used in this will , include children
and issue hereafter born.
